On Thursday, 02/10/2022, Licensing Program Analysts (LPAs) Jan Hoshida and Amanda Sutter conducted an unannounced annual random inspection for the preschool program. LPA met with Director Trinh Nguyen. Upon arrival, LPAs observed 10 children supervised by one staff member.

LPAs conducted a health and safety inspection inside and outside of the facility. The following areas are in compliance during the visit. Firearms and ammunition are not on the premises. Director acknowledged that storage area for poisons needs to be locked and stated that there are no poisons on site. Disinfectants, hazardous items and medications are inaccessible to children. Furniture and equipment are sufficient, age appropriate, and in good repair. Fire drills are conducted and documented. The playground equipment and outdoor activity space is maintained and in good condition. Gravel is being used as cushioning around the climbing equipment and level is sufficient to absorb a fall. Children's toilets, hand washing facilities are sanitary. Floors are clean and free of debris. Food preparation area is clean, food is protected from contamination, storage containers for solid waste are covered, and all food or beverages are stored in covered containers and labeled. Drinking water is available both indoors and outside. Menus are posted. The facility is in compliance with conditions and limitations specified on the license. Sign in/sign out sheets are maintained. No excluded individuals are present. Staff subject to a criminal record clearance or exemption are associated to the facility. First Aid/CPR reviewed and in compliance. Emergency information reviewed for some children. Facility provides breakfast, lunch, and two snack times. Facility’s hours of operation are from Monday through Friday from 7:30 am to 6:00 pm.

At 8:55am, LPAs observed staff #1 alone with 10 children in the front classroom and LPAs observed staff #1 alone in the back classroom with another group of children. At 11:05am during record review, LPAs observed that staff #1 did not have the qualifications to be a teacher on file.

At 8:55am, 9:25am, and 9:45am, LPAs observed staff #1 walk into the kitchen leaving the children in the classroom without direct supervision.

LPA Hoshida informed Director that staff need to have 100% supervision of children at all times. LPA Hoshida informed Director that staff #1 cannot be left alone with the children and has to be supervised by a fully-qualified teacher or needs to submit teacher qualifcations. Director stated that she had been using all staff as teachers, but understands that staff #1 does not have the qualifications therefore will be utilized as an aide.

LPAs observed there was not a Carbon Monoxide detector present in the facility. LPAs did not observe immunizations for pertussis (Tdap), measles (MMR), and influenza within four out of the five staff files. LPAs did not observe current Mandated Reporter training certificates for four out of the five staff files.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPAs discussed current COVID guidelines with Director. Upon arrival, LPA observed that one of the two staff were wearing masks.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA Jan Hoshida informed facility representative Trinh Nguyen that this report dated 02/10/22 documents three (3) Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Jan Hoshida informed the facility representative to provide a copy of this licensing report dated 02/10/22 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
