Licensing Program Analysts (LPAs) Christopher Bello and Mai Lor met with licensee Miriam Edwards for an unannounced random annual inspection and toured areas of the home accessible to children in care. Off-limit areas include front office, laundry room, garage, master bedroom and daughter’s room. Licensee acknowledged that children may never enter these off-limit areas. Upon arrival at approximately 9:32 am LPAs observed 11 preschool children, one infant and four school aged children for a total of 16 children. This is considered an immediate risk to the children in care. LPAs observed three children sitting in high chairs placed in front of the television with the rest of the children. LPAs notified the licensee that children are only meant to be placed in high chairs for eating and is considered a personal rights violation if used as a restraint device. This is considered a immediate risk to the children in care. Licensee stated that they did not know that this was a personal rights violation and removed the children from the high chairs. Also present was licensee’s assistant. Licensee stated there are no new residents in the home since licensure. All Adult residents have criminal record clearances.

LPAs observed current CPR/First Aid certificates which expire on 2/2020. LPAs discussed recent changes in licensing requirements, including the posting of licensing inspection notices and reports and Parent Notification Requirements. LPAs reviewed some children’s files. LPAs observed fire drills were conducted at least once every six months and documented. LPAs notified licensee of upcoming safe sleep and lead testing regulations.

LPAs observed that there were no hazardous items accessible to children. LPAs observed Fireplace which was screened. LPAs observed that cleaning materials were inaccessible. Licensee stated there are no weapons in the home. Fire extinguisher, smoke detector and carbon monoxide detector meet regulation. Toys appear to be safe. The backyard is fenced and gated.
There are no bodies of water observed.

Staffing Ratio and Capacity. The capacity specified on the license shall be the maximum number of children for whom care can be provided. This is not met by evidence: LPAs observed 16 children at time of inspection. This is considered a immediate risk to the children in care.

Licensee acknowledges that she may not exceed the capacity specified on the license. Licensee acknowledges that she must stay within ratio for a large FCCH. Licensee shall ensure that there are no more than specified capacity in care at one time. LPAs will return to clear the deficiency.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPAs observed current Mandated Reporter Training in file.
LPAs checked facilities fees and confirmed that it is up to date.
LPAs provided the Community Care Licensing’s website www.ccld.ca.gov, so the licensee can obtain updated licensing information, new regulations and access forms. LPA advised licensee of their responsibility to stay current in regards to new regulations. LPA also included the email address for the children's advocacy program to stay current on new laws CHILDCAREADVOCATESPROGRAM@DSS.CA.GOV.

Title 22 Deficiencies have been cited on the attached LIC 809D. Upon receipt of Type A citations, facility shall post and provide copies of the LIC 809D for parents/guardians of children currently in care and for parents/guardians of newly enrolled children for the next 12 months. Facility must also keep the signed LIC 9224, Acknowledging Receipt of Licensing Reports LIC 809D in each child's files
