Licensing Program Analyst (LPA) Salene Mayberry met with Director Patricia Pindeo (Jaramillo) for an unannounced Case Management Inspection. LPA observed 4 children being cared for by 1 staff member.

The purpose of today’s inspection was to follow up regarding a water sampling that indicated a Action Level Exceedance (ALE) in an outlet tested for lead levels on 1/14/2023. On 02/10/2023 the facility was notified that water levels were in exceedance of 5 parts per billion in a drinking fountain in the infant room.

Since receiving the notification Director advised they have turned off the water to the outlet with the exceedance and it is no longer in use. Additionally, Director advised LPA that the outlet was not properly conditioned prior to testing due to the owner misunderstanding the requirements. As a result, they are in the process of having the outlet retested to see if the exceedance was accurate. During today’s visit LPA confirmed there is no water being suppled to the outlet and observed caution tape wrapped on the outlet. LPA informed Director that Grant funding for testing and remediation is available and that information could be found in Provider Information Notice (PIN) 21-04-CCP.

A Type B deficiency was cited on the subsequent page (LIC809-D) of this report.

An Exit interview was conducted, and the report was reviewed and provided to Director. LPA posted the Notice of Site Visit and Director acknowledges it must remain posted for 30 days. A Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

LPA confirmed that the facility has shut off water to the outlet and observed caution tape around it to prohibit it being used. Director advised that if there is still an exceedance after retesting, they will replace the outlet and provide LPA with proof.

Lead test results received by Licensing on 2/7/2023, tested on 1/14/2023, showed an outlet in the facility had lead levels exceeding 5 parts per billion (ppb). This poses a potential risk to the health and safety of children in care.
