On 8/1/2024 at approximately 11:45a.m., License Program Analyst (LPA) Pa Dao Vang conducted a complaint investigation inspection and met with the Director Yvette Pimentel. The complaint report was reported to the regional office on 7/31/2024. It was alleged unqualified staff are providing care and supervision to children.

LPA observed 8 infants in care being supervised by Staff 1 (S1) and Staff 2 (S2) with unqualified infant teacher units. The infants were eating lunch in the classroom. At 11:48a.m., the fully qualified infant/toddler teacher stepped into the classroom. The fully qualified teacher stated she stepped out of the classroom for a restroom break and to warmed up some food quickly. She also thought it was okay for lead teachers to step out for a short amount of time if there are staff watching the children. Director also stated the lead teacher was on her 10 minutes break. Based on other staff interviews, there are more than one situation where children were left in the classrooms with no fully qualified teachers supervising. LPA learned the infant room was left with S1 and S2 with unqualifications of infant teacher units for no more than 15 minutes.

Based on the observations, interviews, files reviews, the preponderance of evidence result to substantiating the allegation of unqualified staff are providing care and supervision to children. A Title 22 deficiency is cited on LIC 9099-D page. Facility representative acknowledges, that for TYPE A DEFICIENCIES ONLY upon receipt, facility shall post LIC 9099-D page with Type A deficiency for 30 days and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. LIC 9224 must be signed by parents/guardians and kept with the children's forms as a receipt whenever any Type A documents are provided by the License. LIC 9224 and Appeal Rights were provided. An exit interview was conducted with Director Yvette Pimentel and a Notice of Site Visit posted. Failure to comply with posting requirements can result in a $100 penalty.

An exit interview, review report, notice of site visit, and appeal rights were provided for facility Director Yvette Pimentel. LPA also provided a copy of the LIC9224 form to Director.

(1) An aide who is 18 years of age or older, and who meets the requirements of this section and Section 101216, may escort and/or assist children in going to the bathroom, and may supervise napping children as specified in Section 101230(c)(1), without being under the direct supervision of a teacher.

Based on observations, interviews, and record reviews, the licensee did not comply with the section cited above, as S1 and Ss were observed supervising children in care without the direct supervision of a fully qualified Teacher. LPA learned this happened to all the classrooms due to the fully qualified staff storage. Record review revealed that S1 and S2 are not fully qualified infant teachers. This poses an immediate health, safety or personal rights risk to persons in care.
