On 06/07/2023, Licensing Program Analyst (LPA) Katy Maestas conducted an unannounced field visit to deliver the findings for the above allegation. LPA arrived at the facility and was met by Director Christine Mendoza (D1). LPA disclosed the purpose of the inspection and was granted entrance into the facility. Throughout the course of the investigation, LPA conducted physical plant inspections, on-site observations, and interviews. LPA conducted a file review and collected documentation pertaining to the allegations.
It was alleged that staff do not adequately supervise day care children due to children attempting to walk out of a broken front door. However, no children were able to exit the facility and the staff intervened before children exited the building. Based on interviews, observations, documentation, and other information gathered, there was not a preponderance of evidence to prove or negate the allegation, therefore the allegation is UNSUBSTANTIATED. An exit interview was conducted, and the report was reviewed with D1. LPA provided Licensee Appeal Rights to D1. A Notice of Site Visit was posted by LPA and shall remain posted for 30 days. Failure to comply with posting requirements will result in an immediate civil penalty of $100.

It was alleged that the facility does not provide a safe environment for day care children based on a broken front door. Due to the broken door, children attempted to walk out of the facility and any adult could enter the facility.The physical plant must be kept in good repair to provide a safe environment for the children in care. Based on interviews, file reviews, and observations conducted the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. A Type B citation was issued on a subsequent 9099-D page. An exit interview was conducted, and the report was reviewed with D1. LPA provided Licensee Appeal Rights to D1. A Notice of Site Visit was posted by LPA and shall remain posted for 30 days. Failure to comply with posting requirements will result in an immediate civil penalty of $100.

The front door was repaired before the date of findings. On 04/20/2023, LPA observed a new door sign, an operational pad for door codes and a repaired front door. Additionally, D1 installed new door locks and knobs for the classrooms to ensure safety.

This is a potential health and safety risk to children in care.
