On July 27, 2023, at 11:10 a.m., Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced follow-up complaint inspection and met with facility representative Kecia Loving. LPA disclosed the purpose of the inspection and was granted entry into the facility. 26 school-age children, two teachers and additional staff were present in the facility during this inspection.
On May 25, 2023, the Department received an allegation alleging that on an unknown date, child 1 (C1) vomited on the floor in the classroom. The staff did not clean up the vomit until the next day which resulted in the classroom smelling. Over the course of the investigation, LPA reviewed facility records and conducted confidential interviews with staff, parents, and children. Interviews confirmed that C1 was sick and vomited in the classroom while staff 2 (S2) was present. Staff interviews confirmed the vomit was not cleaned up after C1 became ill. Interviewees reported that when they arrived at school the following day, the classroom smelled, and the vomit had been covered with paper towels rather than cleaned up.

Based on confidential interviews, the above allegation is valid because the preponderance of the evidence has been met, therefore, the above allegation is found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, regulation 101238 (a) Buildings and Grounds is being cited on the attached LIC 9099D.
LPA Kendal Zirbes informed facility representative Kecia Loving that this report dated July 27, 2023 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Kendal Zirbes informed the facility representative to provide a copy of this licensing report dated July 27, 2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. An exit interview was conducted, and the report was reviewed with facility representative Kecia Loving.

Per facility representative, a refresher training will be provided regarding closing and opening procedures and a refresher training on BETCO products will be provided. Documentation of the training will be submitted to the Department.

Based on confidential interviews, the licensee did not ensure the center was clean, safe, and sanitary when vomit was covered with a paper towel and left overnight resulting in the classroom smelling, which poses an immediate Health, Safety, and Personal Rights risk to persons in care.

On July 27, 2023, at 11:10 a.m., Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced follow-up complaint inspection and met with facility representative Kecia Loving. LPA disclosed the purpose of the inspection and was granted entry into the facility. 26 school-age children, two teachers and additional staff were present in the facility during this inspection.
On May 25, 2023, the Department received a complaint regarding the above six allegations. Over the course of the investigation, LPA reviewed facility records and conducted confidential interviews with staff, parents, and children.
The evidence gathered during the investigation reveals conflicting information. Confidential interviews denied being pinched, cussed at, or spanked. Staff reported time outs are utilized for no more than five minutes and the staff utilize redirection techniques in the classroom. Interviews confirmed the center is equipped with cameras and management reviews the footage. In addition, parents are able to view live streams of the classroom throughout the day. Cameras are not present in all areas of the center due to the need for privacy. Report continued on page two

Staff reported ratios are met. The Department conducted an unannounced inspection on May 31, 2023 and did not observe the classroom to be out of ratio. According to interviews, the staff are provided with training regarding the disclosure of confidential information. Interviews denied staff have disclosed confidential information. Staff denies their behavior is a risk to the children in care. Zero witnesses corroborated the above allegations.

Based on the information obtained during interviews the above allegation are being deemed unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

An exit interview was conducted, and the report was reviewed with facility representative Kecia Loving.
