On 12/16/20 at 10:30am Licensing Program Analysts (LPA) Justin Giese conducted a Tele-inspection to the facility to follow up on a Unusual Incident Report (UIR) that was submitted to the Regional Office on 12/14/20. Due to the executive order issued by Governor Newsom on March 16, 2020 regarding COVID-19 pandemic, this investigation was conducted via Tele-inspection. LPA met with Facility Director Amanda Carter to discuss the purpose of the visit. LPA took census, reviewed records, toured the facility (virtually) and conducted interviews with staff and children involved.

On December 14, 2020 Facility Director self reported an incident that occurred December 2, 2020 on the playground. UIR stated Child #1 was running around the play structure on the playground and stopped to throw up near the slide. Staff #1 and Staff #2 were present and providing supervision when the incident occurred. UIR stated the Mother of Child #1 called the facility December 11, 2020 and stated Child #1 threw up due to 4 little boys urinating in to a cup and making Child #1 drink it. UIR stated Child #1 has been in attendance of the facility since the incident occurred.

LPA conducted interviews with Facility Director and Staff #2 during the tele-inspection. LPA was unable to interview Staff #1 due to them being out and self-isolating for possible Covid-19 exposure. Facility staff statements and records review confirm 11 children were in attendance the day the incident had occurred. Statements from Director and Staff #2 both corroborate information provided in the UIR that children were supervised on the playground by Staff #1 and Staff #2. Staff #2 stated she was present the entire time the children were playing and at no time were children unsupervised or able to urinate into a cup. Staff #2 stated Child #1 was running around and playing with other children and at no time did she witness child #1 drink from a cup. Staff #2 stated Child #1 stopped running and playing and threw up abruptly near the slide.

Director stated the Guardian of Child #1 called the facility on two separate occasions (dates and times not provided) after the incident occurred to discuss possible reasons why Child #1 threw up (Con. on LIC809C)

Director stated the first time the Guardian of Child #1 called the facility they stated they were not feeling well and it was possible Child #1 may have have had a stomach bug. Director stated the second call from the Guardian of Child #1 was to inquire about the type of milk the facility provides to children. Director stated Child #1's Guardian called 9 days later with the allegation Child #1 drank urine on the playground. During this time span Child #1 was in continued attendance of the facility. LPA inquired if Child #1 was present during the time of tele-inspection. Director stated Child #1 was no longer enrolled at the facility; however, they were transferred to another affiliated facility in a different city on December 14, 2020.

LPA was unable to interview Child #1 due to them not being present in the facility at the time of tele-inspection. It was alleged by the Guardian of Child #1 that four boys urinated into a cup and made Child #1 drink it on the playground. The provided UIR and interviews with staff did not indicate the names or likeness of the involved individuals.

Based on LPA's observations, interviews and information obtained during the visit, there appeared to be no violation of Title 22 Regulations pertaining to the reported incident.

An exit interview was conducted with facility Director, Amanda Carter. LPA Giese provided the Director with a copy of this report via email, LPA asked the Director to acknowledge receipt of the email. An electronic “read receipt” was also attached. The electronic read receipt or reply of the emailed report acknowledges receipt of this report. A copy of this report and notice of site visit was emailed to the Director during this Tele-inspection on December 16, 2020.

No deficiencies sited at this time. A copy of this report must be made available for the next three years.
