On 10/14/2022, Licensing Program Analyst (LPA) Rachel Zeron arrived at the facility to continue the complaint investigation initiated on 09/01/2022 concerning the above allegation. During the visit, LPA Zeron took a census of the children present, and this time met with Director Jennifer Diehl to discuss the outcome of the complaint investigation. Based on all the information obtained, the following is the outcome of the investigation regarding the allegation:

During the investigation, LPA made observations, conducted interviews with staff and all other relevant individuals pertinent to this investigation. It is alleged that on or about September 1, 2022, a child was found wandering in the library/common area located outside if the child's classroom. Another staff (S2) found the child and took the child to staff's (S2) classroom without informing staff (S1) that the child was found. Soon after, the child's responsible party arrived to pick up the child and staff (S1) was made aware that the child was found in the library/common area wandering unsupervised by staff (S2). Staff (S1) admitted that they were not aware of the child missing and that the child has a history of wandering behaviors that staff (S1) was unaware about.

Based upon the information gathered and interviews conducted, the preponderance of evidence standard has been met, and therefore, the allegation, staff was unaware that child left the classroom is found to be SUBSTANTIATED.

See LIC 9099D for deficiency cited.

An exit interview was conducted, and a copy of this report was reviewed and provided to the Director, Jennifer Diehl. Appeal rights were discussed and provided during the exit interview.

A notice of site visit was given and must remain posted for the next 30 days. A civil penalty was also issued on this date.

Director must have parents of all current and any newly enrolled clients within the next 12 months, complete the Parent Notification Requirements form LIC 9224, and place the completed form in the child’s facility file. A civil penalty of $100 per violation will be assessed for noncompliance

During the investigation, LPA made observations, conducted interviews with staff and all other relevant individuals pertinent to this investigation. It is alleged that staff grabbed and pulled child by the arm, with no dates given. Based on interviews conducted, LPA was unable to corroborate if a child's personal rights were violated. Therefore, due to conflicting information found throughout this investigation this agency has investigated the complaint alleging: Staff grabbed and pulled a child by the arm is UNSUBSTANTIATED at this time. Although the allegation may have happened, or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

Director agreed to conduct a training on section CCR 101229, lack of supervision, with all staff. Director will submit a copy of the staff roster once training is complete. Director submitted a copy of the write up/coaching regarding the incident with staff involved. Roster is due to CCL by POC date

Based on interviews conducted and documentation obtained, lack of supervision did result in a child being found in library/common area unattended by another staff.
This is an immediate risk to the health and safety of children in care.
