Due to required lead testing requirements, Licensing Program Analyst (LPA), Susan Brewer conducted a Case Management inspection based on lead testing results received on the facility for a separate component at the same location. LPA S.Brewer toured the facility, took census and met with Licensee Director Wendy Leath, to further discuss lead results received and measures taken for remediation of lead exceedances.

During the inspection, LPA S. Brewer, inquired about the sources of water for consumption and the identified location of the sources. Per director W. Leath, water for food preparation and consumption is obtained by kitchen tap water, for all programs operated at the location. LPA toured the kitchen area where 3 kitchen sink faucets are used by facility staff for re-filling water jugs/pitchers and for food preparation to serve school age classrooms..

After review of the facility map and list of outlets identified in the test results provided from reports dated 08/18/2022 and 11/07/2022, the A-Tech Consulting Inc, did not conduct testing on the 3 outlets, observed by the LPA as kitchen sink faucets. The licensee was unable to provide proof of lead testing conducted for the 364813348 Tutor Time Child Care Learning Center’s kitchen sinks/faucets.

Based on the LPA's record review and observations, it was revealed that the agency failed to have a total of 3 kitchen sink faucets tested for safe lead levels of 5.5 ppb or below, where staff currently use the faucets as water sources for the school age classroom. Therefore, it was determined that the facility did not meet compliance with this standard as described in the written directives outlined in PIN 21-21-CCP.

101700.6 Grant Funding for Qualifying Child care Centers

(a) Senate Bill 862, Chapter 449, Statutes of 2018 allocated $5 Million to the State Water Resources Control Board for testing and remediation of lead in the drinking water of Child Care Centers based on the following criteria:

(1) Those that serve children zero to five years of age, with the highest priority for Child Care Centers that provide care for children zero to three years of age.

(2) Those that have 50 percent or more of their registered children who receive subsidized care.

(3) Those that operate only one facility.

(b) To determine a Child Care Center’s eligibility for possible funding the Department will provide access to a link to an online eligibility form located on the Department’s website and on Sacramento State’s Office of Water Programs website.

(1) A Child Care Center interested in financial assistance shall complete the eligibility form, which shall include instructions for completing and returning it, prior to receiving any grant funding for which it may qualify. To determine a Child Care Center’s eligibility for possible funding, the provider will need to complete an online eligibility form available at Office of Water Programs’ website

Due to the agency not taking action to test for the school age program as required in the Health and Safety Code Section 1597.16(a)(1), where all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, deficiency has been cited. See LIC809D.



An exit interview was conducted and appeal rights discussed. LPA S. Brewer provided Director Wendy Leath, with a copy of this report, appeal rights and notice of site visit. This report must be made available to the public upon request for three years.
