On 12/07/2021, Licensing Program Analyst (LPA) Rachel Zeron conducted an unannounced visit to the facility and met with Director, Laura O’Brien for the purpose of delivering findings of this complaint that was initiated on 09/21/2021. Per the Director, there were 53 children in care.

During the investigation, LPA Zeron reviewed facility documentation and conducted interviews with relevant individuals pertinent to this investigation. It is alleged that on or about September 16, 2021 a child was dropped off at the facility at approximately 8:45am and picked up at approximately 12:30pm. After receiving a call from the Director at 9:30am indicating that the child was crying a lot. That evening, while child’s representative (CR) was showering the child, CR noticed bruising on child’s rib cage area and scratch marks under both arm pits. The following morning, when child was dropped off at the facility, CR asked child's teacher about the injuries. The teacher indicated that it was unknown how the injuries occured, the child was crying a lot and the Director came into the classroom "clapping at the child" and telling him to "stop crying" and removed him from the classroom and took him into her office and called the child's representive to pick the child up. During interviews with staff, there was no indication that the Director had taken the child into the director's office on 09/17/2021. Staff denies witnessing the director yelling at or mistreating children. Staff indicated that the Director is good with the children. On occasion, Director will remove the child from the classroom per the teacher's request and take the child to the Director's office to "cool down" for a short time and then take the child back to the classroom. Director indicated that the office door is never shut when a child is in the office. Director denies the allegations regarding the injuries to the child. Staff interviews also indicated that the teacher in the child's classroom, would speak loudly to the children at times and some of the children felt intimidated by the teacher.

LPA determined there is conflicting information regarding a Day care staff causing injuries to child while in care. There were no eye witnesses to the alleged incidents reported and the child in question and other pertinent sources were not able to participate in the investigation.

Although the allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are deemed UNSUBSTANTIATED at this time.

No deficiencies were cited. An exit interview was conducted, and a copy of this report and a Notice of Site VIsit (required to be posted for the next 30 days) was provided to the Director Laura O'Brien on 12/07/2021. LPA verified the Notice of Site Visit was posted in a prominent location before leaving the facility.
