Licensing Program Analyst (LPA) Rachel Zeron conducted an unannounced visit to the facility for the purpose of delivering findings of this complaint that was initiated on 08/31/2021. LPA met with Director, per the Director there were 12 children in care, LPA toured the facility and discussed the purpose of the visit.
During the investigation, LPA Zeron reviewed facility documentation, conducted interviews with relevant individuals pertinent to this investigation. It was alleged that infants are not constantly supervised and under direct visual observation and supervision by a staff person at all times. According to the complaint, staff is looking at their phones and not watching the children during naps, unless they heard a noise then they would look up from their phones. 1 year old room is split in half with dividers; when teacher leaves one side of room to prep meals in kitchen (next to 1 year old room) the teacher cannot see from kitchen past dividers to where 1 year olds are left alone (no line of sight). One year old room changing table is against the wall so teacher's back is to the children while changing a diaper. Interviews and observations revealed the following: LPA toured the 1 year old room, the first room has a changing table that faces the wall. There is a mirror in front of the table where the staff can see the children behind the staff. Since the table is in the left corner, staff is able to view children on the right side.

Staff indicated that before changing a child, staff would put children in a circle time or at one of the tables where the children are in view. Staff deny using their phones while infants are napping. Staff indicated they take lunches during nap time, leaving two staff to supervise the infants in care.

It was also alleged, passageways are not kept free of obstruction. According to the complaint, Three doors lead out of the 1 year old room to hall/other rooms and teachers put toys in the doors to keep them ajar during nap times so alarms don’t sound when folks go in/out which creates a tripping hazard. Interviews and LPA observations revealed that during nap time the door is left open with the door stopper in place to keep the children from waking. Staff will alternate care to accommodate lunches and door that leads into the 1 year old room has a chime when opened. LPA's observations revealed that there are two gated areas inside the classroom where the classrooms are separated and the children have no access outside these areas unless a staff escorts the child. Interviews with staff deny putting toys in the doorway to prop the door open.

The evidence gathered during the investigation reveals conflicting information. Staff denies allegations and other staff cannot corroborate the allegations. Although, the allegations may have happened or is valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are deemed unsubstantiated at this time.
Exit interview was conducted with Director, Ana Cruz. Notice of Site Visit was issued and must be posted for 30 day. A copy of this report was provided to the facility.

A copy of this report must be made available to the public for 3 years upon request.
