Licensing Program Analysts (LPA) Blanca Ruiz-Silva, arrived at the facility to conclude an investigation into the above allegation, prior visits were made on 07/23/19 and 08/15/19 regarding the above allegation. LPA met with Director, Teresa Fortunato at the time of the inspection and stated the purpose of the investigation. The center was toured and a census was taken.

It was alleged that on or about the last week of 07/2019, children’s personal rights were violated while in care.
Information obtained during the course of the investigation by witnesses, staff and pertinent parties revealed that children personal rights were violated by multiple children while in care at the facility.

It was disclosed by the facility that couple of children were using extremely foul language with in class and they were also displaying disruptive behavior such as threating to kill facility’s staff and kicking them in the presence of other children in care. Children’ in care expressed feeling sad, scared and concern with their safety and staff. During inspection conducted on 08/15/19, director confirmed that Child#1 and Child#2 have been removed from the facility the last week of 07/2019 and first week of 08/2019.

Licensee agrees to submit a written statement to CCL regarding 101223(a)(2)to ensure that children's personal rights are not violated by updating Creative Kids Preschool and Daycare guidelines and procedures. In service training was provided to staff on 07/2019.

Facility failed to provide a safe environment. Children in care were scared and intimidated by Child#1 and Child #2 who were agressive towards staff and other children for several months.
This poses an immediate risk to the Health and Safety of the children in care.

Based on the above information and LPA’s observation on 07/23/19 the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

California Code of Regulations, (Title 22, divisions & chapter number are being cited on the attached LIC 9099D.) Exit interview conducted and a copy of this report was provided to Teresa Fortunato, appeal rights were given on this date along with a Notice of Site Visit.
