On November 29, 2023, Licensing Program Analyst (LPA) Zirbes conducted a follow-up complaint inspection to Ready Set Grow Learning Services. LPA met with facility representative Zaray Ochoa. The purpose of the inspection was to deliver the findings for the above complaint allegations. The investigation included inspections of the facility, a review of facility records, and confidential interviews with staff, parents, and children.
On September 6, 2023, the Department received four allegations. Two allegations were involving an incident that occurred in September 2023 involving staff 1 (S1) and parent 1 (P1). The allegations alleged that S1 used racial slurs while engaging in a verbal altercation with P1. It was alleged that the incident occurred in the presence of childcare children. The third allegation alleged that in May 2023 the Center had expired food in the kitchen. The fourth allegation alleged that an unknown staff member was busy surfing their cell phone rather than supervising the children in care.

While investigating the two allegations regarding the verbal altercation, it was confirmed a verbal altercation occurred over the phone in September 2023 when P1 was in the main office of the center while S1 was on S2's cellphone speaker during the conversation. The investigation could not conclude if the verbal altercation and S1s comments were overheard by the childcare children in care.
Over the course of investigating the food service allegation, and the supervision allegation. LPA completed unannounced inspections at the Center on September 11, 2023, October 9, 2023, and October 19, 2023. LPA did not observe expired food in the kitchen during the inspections. LPA observed the staff engaged in outdoor and indoor activities with the children. Confidential interviews denied issues with food service at the Center and expressed the staff utilize their personal cell phone to assist with classroom activities. Management staff reported the staff are allowed to have their personal cell phones in the classroom to assist with activities. Management denied staff members have failed to follow the personal cell phone rules in the classroom. Due to conflicting information, the investigation could not conclude if the Center served expired food in May 2023 or if the staff failed to provide supervision which met the needs of the children.

Based on the information obtained there is not enough evidence regarding the allegations of staff engaged in a verbal altercation in the presence of children, staff used racial slurs in the presence of children, staff did not provide adequate food service, and staff member is usually busy surfing their cell phone and doesn't supervise children properly. Therefore, the allegations are deemed UNSUBSTANTIATED at this time. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted, and the report was reviewed with facility representative Zaray Ochoa.
