Due to COVID-19, Licensing Program Analyst (LPA) Taadhimeka Zeigler conducted a Tele-Inspection with Director, Brittany McGuire, for the purpose of delivering the findings of this complaint that was initiated July 27, 2020. LPA met with Director McGuire, via Zoom, and explained the nature of the Tele-Inspection.

During the investigation, LPA Zeigler reviewed facility documentation, conducted interviews via Zoom with relevant individuals pertinent to this investigation. It was alleged that on or about July 20, 2020, due to lack of supervision, there was inappropriate interaction between children on the playground.

Interviews revealed that while on the playground on or about July 20, 2020, at least one child exposed himself to other children. Con't on LIC 9099D

Interviews also revealed that one child held another child down on the ground. This was not an isolated incident and due to the lack of visual care and supervision by staff, this type of incident has happened on more than one occasion. Interviews disclosed that staff are present on the playground when children are present, however, staff are not providing proper visual oversight to prevent these incidents from occurring.

Based on interviews with pertinent parties, records reviewed, and witness observations, the department has determined the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

Due to COVID-19 State of Emergency, LPA conducted an exit interview via Zoom and provided an email copy of this report to the Director. LPA Zeigler requested the Director to acknowledge receipt of the report by replying to the sent email. The electronic response from the Director, will serve as the read receipt of the emailed report. Director McGuire understands that a copy of this report must be made available to the public, upon their request, for the next three years. LPA issued a Notice of Site Visit and verified it was posted in a prominent location at the facility before ending the tele-inspection. The Director understands that the Notice of Site Visit must remain posted for the next 30 days along with a copy of all Type A deficiencies cited during this tele-inspection.

A copy of all Type A deficiencies cited during this tele-inspection must also be immediately (within 24 hours of child’s next day in care) given to the parents of all children enrolled in the child care facility and any children enrolled into the child care facility over the next 12 months (at the time of enrollment). Director is required to have all parents sign and date the Acknowledgement of Receipt of Licensing Reports (LIC9224) and maintain a copy in children’s files. A copy of this report, LIC9224 and Appeal Rights (LIC9058) were emailed to Director McGuire during this tele-inspection.

Director agrees to provide in service training with staff on supervising children at all times to ensure proper behavior on the playground. Provide a sign-in sheet of staff present and the agenda items discussed.

Interviews determined that on or about July 20, 2020, children were engaging in inappropriate activity by exposng themselves to one another and by one child kneeling on the neck of another, while on the playground. It has been determined that while staff are on the playground when children are present, staff are not providing proper visual oversight to prevent these incidents from occurring, which poses an immediate risk to children in care.
