On 11/6/2020 at 9:02 AM, Licensing Program Analyst (LPA) Patricia Berry conducted a tele-inspection visit, via Google-Duo, due to COVID-19 and DPH guidelines of social distancing. The purpose of the tele-inspection visit is to deliver the concluded findings for the above allegations. LPA made contact with the licensee, took a census and reviewed the concluded complaint finding. The investigation was initiated on 10/26/2020, at which time it was extended to gather additional information. Since then, additional interviews was conducted. During the Google-Duo tele-inspection visit, LPA was able to observe the children and tour the daycare room. The following information was received and obtained regarding allegations:

Adult in the home handled day care child in a rough manner
It was reported Staff #1 took a child by their arms and shook the child because the child was wiggling while on time-out. Licensee denies the allegation. Licensee stated when chidren are placed in time-out, the child is redirected to a table and is given a puzzle, coloring book and crayons, and other things.

Staff #1 stated they have never handled any of the children in a rough manner. Staff #1 stated when a child is not listening, they get down to the child’s eye level, and talk with the child. Staff #1 stated when a child is redirected to a table due to the child not listening, the child does not have to sit down and stay seated. Staff #1 stated while at the table, the child has their choice of a puzzle, or coloring, or something to keep them occupied. Staff #1 stated they feel redirecting is better for the children.
Based on interviews conducted, there is conflicting information whether a child was handled in a rough manner; therefore, based on the information received, and interviews conducted, the above allegation is unsubstantiated.





Licensee hit day care child
It was reported the licensee slapped a child in the face because the child was not listening. Licensee stated they have never touched a child in a negative way. Licensee stated her policy is to talk to a child at their eye level if a child is struggling with not following the rules.
Staff #1 stated they do not touch children in any negative way. Staff # 1 stated they talk to a child when a child is not listening. Staff #1 stated they never hit their own, let alone a day care child.
Based on interviews conducted, there is conflicting information whether the Licensee hit a day care child; therefore, based on the information received, and interviews conducted, the above allegation is unsubstantiated.

Licensee failed to assist a child with diaper changes

It was reported a child was made to put their own diaper on and fasten the tabs to the diaper without the assistance of anyone. Licensee denies the allegation. Licensee stated she has the child pull their diaper up and down when going potty, in order to develop self-help skills.


Based on interviews conducted, there is conflicting information whether the Licensee failed to assist a child with diaper changes; therefore, based on the information received, and interviews conducted, the above allegation is unsubstantiated.


Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.



Reports must be kept at facility for three years.


LPA contacted the Licensee to review the report. This report will be sent via email to the provided email address with an attached read receipt. LIC 9213- Notice of Site Visit was issued and must be posted for thirty days. The read receipt will be used in lieu of the signature on the report.
