Licensee has requested for capacity increase to 12 children. Licensing Program Analyst (LPA) Kim Leung arrived at the facility to conduct a comprehensive inspection as part of a compliance review. LPA toured the facility, inside and out, records were reviewed and the following was observed and/or discussed:
Normal days and hours of operation are: Monday through Friday from 7am to 6pm
OFF-LIMIT AREAS INCLUDE: The master bedroom, the bedroom at the end of the hallway by the bathroom and the garage
The facility is operating within the licensed capacity and appropriate ratios
· Appropriate supervision provided during this inspection
· A working telephone is present
· Fully-charged fire extinguishers rated 2A:10BC is available at this home. Smoke detector and carbon monoxide detector present and were tested by the licensee during this inspection and found to be in working condition.
· All hazardous items indoor are stored inaccessible to children. There are poisonous plants (oleander and birds of paradise) in the backyard which have a fence at the bottom but the plants are stretching out and reachable to older children. Licensee agreed to trim the plants prior to receiving older preschool-age children in care. Pictures and written statement will be submitted.
· No guns or weapons present as stated by the Licensee Tania Alamin and co-licensee Aron Cunningham. Licensee understands all guns, weapons and ammunition must be key-locked separately and made inaccessible per Title 22 Regulations
· Single story home
· Verification of control of property on file (rental agreement)
· License, Facility Sketch, Emergency Disaster Plan & Notification of Parent’s Rights poster are posted
· Pediatric CPR and First Aid Card expired on 10/19/2021 for licensee Tania Alamin co-licensee Aron Cunningham
· Health & Safety Certificate - completed on 4/29/2017 for licensee and co-licensee
· No bodies of water at this time. There are 2 water fountains, one in the front porch and the other one in the back yard. LPA observed no water in the fountains. There are sand bags in both fountains. Licensee understands all bodies of water including ponds, above ground pools & spas, in-ground pools & spas, and some fountains must be properly covered or fenced per Title 22 Regulations. The Department must be notified before and after installation of the above

types of bodies of water. In addition, all wading pools or similar product must be emptied immediately after use and stored in an upright position.
· Clean, safe and age appropriate toys. The backyard is not completely fenced. Licensee and co-licensee understand that they have to be physically present with the children in the backyard when children are in the backyard.
· Current roster on file
· Documentation of fire drills on file. The most recent fire drill and earthquake drill were conducted on 7/30/2021 per drill log.
· Children’s records are complete except for that LIC9227 Infant Sleeping Plan for a young infant is not on file.
· No employee at this time. Licensee agreed to submit TB test report with result for one of the adult residents by 9/3/3021.
· Licensee and co-licensee renewed their Mandated Reporter Training on 9/28/2019.
· Criminal record clearances are required prior to all adults living or working in a Family Child Care Home. A civil penalty of $100.00 per day the person has been present, may be assessed. Resident and/or staff records reviewed on 8/24/2021 indicate that all adults who require caregiver background checks have received all required clearances or exemptions.
· Facility is not currently providing IMS Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. Prior to any IMS is provided an updated Plan of Operation that includes IMS must be submitted to the Department. - AB 1819 – Smoking prohibition on the premises of Family Child Care Homes, effective January 1, 2015 – This bans smoking tobacco in a home that is licensed as a family child care home, and in those areas of the family child care home where children are present. - AB 2621 – Public information posted on the internet, effective January 1, 2015 – The Department shall post licensing information for Family Child Care Homes on its Internet Web site.
This information will be updated at least monthly on the website and will span the preceding five-year period.
- AB 2386 – Carbon Monoxide Detector Regulations, effective January 1, 2015 – In accordance with California Health and Safety Code Section 1975.543 - Every family day care home for children shall have one or more carbon monoxide detectors in the facility that meet the standards established in Chapter 8 (commencing with Section 13260) of Part 2 of Division 12. The department shall account for the presence of these detectors during inspections.
- AB 2236 – Civil Penalties, effective July 1, 2015 – Enacts new civil penalties in cases where the Department determines that a violation of licensing standards resulted in the death or serious injury, or constitutes physical abuse of a child in care. The bill establishes an appeal procedure specific to these civil penalties. The bill also expands the scope of the Child Health and Safety Fund in order to assist parents in securing alternative child care when a Child Care Center or Family Child Care Home license has been suspended or revoked. These civil penalty amounts are scaled in relation to the total capacity of all of the licensee’s facilities and not just the specific facility cited or limited to that facility type.
- SB 277 – Immunizations, Personal Beliefs Exemption, effective January 1, 2016 - it eliminates the exemption from existing specified immunization requirements based upon personal beliefs, and only allows an exemption from future immunization requirements deemed appropriate by the State Department of Public Health or a medical professional for medical reasons.
- AB290 – Child Nutrition, effective January 1, 2016 - – In accordance with California Health and Safety Code Section 1596.866 - each family day care home licensee who provides care, shall have at least one hour of childhood nutrition training as part of the preventive health practices course or courses.
- SB792 – Immunization requirements for staff, volunteers, effective September 1, 2016 – In accordance with California Health and Safety Code Section 1597.622 (a)(1)- a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination or they may provide a statement declining the vaccination. If employees/volunteers are receiving the influenza vaccination, they must do so between August 1 and December 1 of each year.
- AB2231 (2016) – Increased Civil Penalties, effective July 1, 2017 – For failing to correct a violation the civil penalty is increased to $100 per day for EACH violation until corrected; For failing to correct a repeated violation the civil penalty is increased to $250 immediately assessed , and $100 per day afterwards for EACH repeated violation until corrected; For a Zero Tolerance violation the civil penalty is increased to $500 immediately assess, and $100 per day for EACH violation after that until corrected; For any repeated Zero Tolerance violation the civil penalty is increased to $1,000 immediately assess, and $100 per day afterwards for EACH repeated violation until corrected.
- AB 1207 – Mandated Child Abuse Reporting: Child Day Care Personnel Training, beginning January 1, 2018 – In accordance with California Health and Safety Code Section 1596.8662 – requires all licensed providers, applicants,

directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Applicants must meet requirements as a precondition to licensure. Existing licensees must meet requirements by March 30, 2018. New employees shall have 90 days to complete training as required. This training requirement may be directly met by using the Department’s Office of Child Abuse Prevention (OCAP) online training modules. The OCAP modules are free of cost and available at: http://www.mandatedreporterca.com/ and are provided in English and Spanish. If no training is made available in a required person’s primary language then those persons shall be exempt from this requirement
NOTE: Repeat violations are defined as a violation of a previously cited statutory or regulatory Section and/or subsection within 12 months prior.

If a serious violation is cited, a copy of the licensing report (LIC809/LIC9099) must also be posted for 30 days. A civil penalty of $100 per violation will be assessed for noncompliance.

See LIC809D for cited deficiency. Appeal rights discussed and a copy of this report was provided to the licensee on this date.

A fire clearance has been obtained, Once the correction and the requirements have been completed, this application will be submitted for approval for a capacity of 12 children without the Property Owner/Landlord Consent or 14 children with the Property Owner/Landlord Consent. Exit interview was conducted with licensee Tanya Alamin.

During the exit interview, licensee Tanya Alamin confirmed that there are no Registered Sex Offenders living in the facility and/or using the facility address for their mailing address.

A NOTICE OF SITE VISIT WAS ISSUED AND IS TO BE POSTED IN A PROMINENT LOCATION AT THE FACILITY FOR THE NEXT 30 DAYS. A copy of this report was provided to the licensee on this date and must be made available to the public upon request for the next 3 years.
