On the above date and time, Licensing Program Analyst (LPA) Diana Brasel conducted a tele-inspection visit via Duo, due to COVID-19 and DPH guidelines of social distancing. The purpose of the tele-inspection visit is to deliver the concluded findings for the above allegations. LPA made contact with the director, took a census and reviewed the concluded complaint findings. The investigation was initiated on 05/27/2020, at which time it was extended to gather additional information. Since then, additional interviews were conducted. During the Duo tele-inspection visits, LPA was able to observe the infants, staff, and see the infant room. The following information was received and obtained:

1. It was alleged that staff "wrap the babies like burritos with soft blankets (swaddle)”.
LPA observed during both tele-inspection visits one or more infants napping in cribs that were not swaddled. The infants were sleeping per Safe Sleep requirements, on their back. The information obtained through multiple interviews is that the staff do not swaddle the babies.

2. It was alleged that “staff prop baby bottles if they can’t hold themselves”. The information obtained through multiple interviews is that if the infant is unable to hold their bottle, the staff holds the infant and feeds them. The older infants that can hold their own bottle lay on boppy pillows holding their bottle with the staff next to them.

3. It was alleged that “staff are not in the napping area, have backs to the infants, and are on cell phones not watching the children”. LPA observed during both tele-inspection visits, a staff member in the napping area with at least one or more sleeping infant. The information obtained through interviews is that there is always a staff member in the infant sleeping area. The other staff members are with the other children in the activity area. The staff cell phones are used to play music for the infants, not personal use.

During this investigation, conflicting information was received regarding the allegations that are in question and the allegations were denied. The interviews and evidence provided have not shown sufficient evidence of children's personal rights being violated while in care. Based upon LPA's own observation and the information gathered throughout the investigation process, there is not a preponderance of evidence to corroborate the allegations.

The Department has investigated the above allegations and although they may have happened or been valid, there is not a preponderance of the evidence to prove that an alleged violations occurred, the Department’s finding is that these allegations are unsubstantiated.

LPA contacted the Director to review the report.
This report will be sent via email to the provided email address with an attached read receipt.
A copy of the LIC 9058 will be sent via email along with the report.
The read receipt will be used in lieu of the signature on the report.
All reports shall be maintained for three years.
