On December 16, 2024, Licensing Program Analyst (LPA) Calloway made an unannounced inspection to the KCE Champions LLC @ Discovery of the Arts day care center. The purpose of the visit was to deliver findings regarding the above complaint allegation. LPA met with the Director who granted access. LPA observed five children and six staff in care.
During the investigation, LPA conducted confidential interviews with all relevant parties involved. Based on interviews and record reviews Allegation #1- On October 15, 2024, Child 1 was smacked in the face by another day care child while in care. The interviews revealed children at the day care are being bullied by other daycare children they are scratched, pushed, and their hair is pulled. The record reviews revealed the staff was not consistent with following the behavior guidance procedures that could have prevented the incident from occurring. Therefore, the evidence corroborates with the allegation above that staff did not prevent child from bullying another child in care and the allegation on Personal Rights is substantiated meaning the preponderance of the evidence standard has been met.

An exit interview was conducted, and a copy of this report was read, Appeal Rights were discussed, and a Notice of Site Visit, and a copy of all forms mentioned in this report were provided to the Cristinn Nila, Director at the facility. A Notice of Site Visit must remain posted for 30 days. Removal of the posting is subject to a $100 civil penalty.

Per the Director, we will suspend the child if they are hitting or bullying and document to the parent and if it continues we will put the child on the ABC chart and track the behavior and if that doesn't work, we will contact the Administrator and possibly remove the child.

Based on interviews and record reviews Child 1 was smacked in the face by another daycare child while in care. The staff did not follow behavior guidance to prevent the incident from occurring which is a potential health, safety, or personal rights violation to the persons in care.

On December 16, 2024, Licensing Program Analyst (LPA) Calloway made an unannounced inspection to the KCE Champions LLC @ Discovery of the Arts day care center. The purpose of the inspection was to deliver findings regarding the above complaint allegation. LPA met with the director who granted access. LPA observed five children and six staff in care.

During the investigation, LPA conducted confidential interviews with all relevant parties involved. Allegation #2- On October 17, 2024, Parent 1 was allowed inside the daycare to inspect the facility and spoke to the staff. Based on the interviews, the staff do allow the parents to come inside the facility to assist their children getting their belongings and speak to the staff, but for safety reasons, the parents are not allowed to engage with other daycare children or stay inside the daycare for long periods of time. Therefore, allegation #2 staff interfered with parent’s right to inspect the facility is Unsubstantiated, meaning, the allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.
