On August 26, 2021 at 2:25 PM, Licensing Program Analyst (LPA), Marie Hernandez conducted an
unannounced complaint investigation inspection to deliver the complaint findings for the above
allegation. LPA met with the Facility Director, Jo Cantwell. Present are forty seven children with seven
staff. Through the course of the complaint investigation, LPA conducted several confidential interviews
with the Facility Representatives, fifteen day care children, twenty day-care parents, eight staff and the
witness. During the initial complaint investigation on 06/08/2021, LPA conducted an inspection of the
facility including the outdoor play-yard. LPA did not observe any cat feces or hazardous foreign materials
in the sandbox at time of inspection. The Department received a complaint alleging that the sandbox is not kept free of hazardous foreign materials. It is alleged that a cat was using the sandbox as a litterbox and brought in dead birds and mice. Interviews reported that there were several witnesses that observed the dead mice and the cat feces in the sandbox and that there were instances where the children were unable to use the sandbox. The Director stated on 06/10/2021, she had the sand disinfected by a professional vendor.

The vendor applied a hospital grade disinfectant to all areas on the play-yard sand. The vendor also applied Prokure V disinfectant to the surface of the sand and as per the vendor, the disinfectant is not dangerous to humans. The facility is on a shared property and the owner of the cat has since relocated the cat. The Director stated they will continue to ensure that the play-yard including the sandbox will be kept clean and free of any hazardous foreign materials.

Based on the evidence obtained and the confidential interviews, the Department has found there is a preponderance of evidence to prove the alleged violation of the “Sandbox is not kept free of hazardous foreign materials,” did occur, therefore the allegation is determined to be SUBSTANTIATED. Title 22 Regulations, Section 101238.2(f) Outdoor Activity Space is being cited on the attached LIC 9099D. This poses an immediate health and safety risk to children in care.

LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Facility Director, Jo Cantwell. The following reports were provided to the Facility Director: LIC9099, LIC9099-C, LIC9099-D, Appeal Rights (LIC 9058), Acknowledgement of Receipt of Licensing Reports (LIC 9224) and the Notice of Site Visit (LIC 9213). The Director was advised that the Type A Complaint Investigation Report and the Notice of Site Visit shall be posted for 30 days and shall provide a copy of the licensing report along with the Acknowledgement of Receipt of Licensing Reports (LIC 9224) to the parents/guardians of children in care at the facility and to the parents/guardians of children newly enrolled at the facility for the next 12 months. In addition, the LIC 9224 must be signed by parents/guardians of children currently in enrolled and by parents/guardians of children newly enrolled at the facility and placed in each child’s record for the next 12 months.

On 06/10/2021, the Director corrected the deficiency. On 06/10/2021, the Director had a professional vendor procure and disinfect the sand in the play-yard. Based on interviews and documents obtained, the facility did not keep the sandbox free of hazardous foreign objects. A cat used the sandbox in the play-yard as a litterbox on multiple occasions and brought dead mice into the sandbox. This poses an immediate health and safety risk to children in care.

During the initial complaint investigation on 06/08/2021, LPA conducted an inspection of the facility
including the outdoor play-yard and the sandbox. LPA did not observe any cat feces or hazardous
foreign materials in the sandbox at time of inspection. The Department received a complaint alleging that a child in care contracted a skin infection from the cat feces after playing in the sandbox. The Director denied the allegation and stated no one reported a child contracting an infection from the sandbox. Interviews revealed the cat lived at the church which is on the same property as the facility and that the cat used the play-yard sandbox as a liter-box. Several day care children stated they observed the cat bringing in a couple of dead mice in the play-yard and in the sandbox. The facility was not informed of a child having a skin infection and then information provided, did not prove that a child contracted a skin infection while in care.

Based on interviews and information obtained, there was conflicting evidence to corroborate the allegation that “Child contracted a skin infection while in care”, therefore the allegation is found to be UNSUBSTANTIATED meaning that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Facility Director, Jo Cantwell. The Director was provided a copy of the report, Notice of Site Visit, and the appeal rights. LPA observed the notice of site visit being posted at the facility.
