32 | The vendor applied a hospital grade disinfectant to all areas on the play-yard sand. The vendor also applied Prokure V disinfectant to the surface of the sand and as per the vendor, the disinfectant is not dangerous to humans. The facility is on a shared property and the owner of the cat has since relocated the cat. The Director stated they will continue to ensure that the play-yard including the sandbox will be kept clean and free of any hazardous foreign materials.
Based on the evidence obtained and the confidential interviews, the Department has found there is a preponderance of evidence to prove the alleged violation of the “Sandbox is not kept free of hazardous foreign materials,” did occur, therefore the allegation is determined to be SUBSTANTIATED. Title 22 Regulations, Section 101238.2(f) Outdoor Activity Space is being cited on the attached LIC 9099D. This poses an immediate health and safety risk to children in care.
LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Facility Director, Jo Cantwell. The following reports were provided to the Facility Director: LIC9099, LIC9099-C, LIC9099-D, Appeal Rights (LIC 9058), Acknowledgement of Receipt of Licensing Reports (LIC 9224) and the Notice of Site Visit (LIC 9213). The Director was advised that the Type A Complaint Investigation Report and the Notice of Site Visit shall be posted for 30 days and shall provide a copy of the licensing report along with the Acknowledgement of Receipt of Licensing Reports (LIC 9224) to the parents/guardians of children in care at the facility and to the parents/guardians of children newly enrolled at the facility for the next 12 months. In addition, the LIC 9224 must be signed by parents/guardians of children currently in enrolled and by parents/guardians of children newly enrolled at the facility and placed in each child’s record for the next 12 months. |
