On November 9, 2021, at 10:30 AM, Licensing Program Analyst (LPA), Marie Hernandez conducted an unannounced complaint investigation inspection to deliver the complaint findings for the above allegations. LPA met with the Facility Director, Amy Fagan. Present are sixty two children with thirteen staff.

Through the course of the complaint investigation, LPA conducted several confidential interviews with the Facility Director, seven staff, fifteen day care children, and thirteen day-care parents. During the initial complaint investigation on 09/01/2021, LPA conducted an inspection of the facility including the outdoor playgrounds and thee gates. LPA did not observe any safety hazards or the playground gates left unopened or unlocked at time of inspection. LPA observed that the playgrounds are enclosed by a fence. The Department received a complaint alleging that the playground is not appropriately enclosed while children are in care and the staff do not provide appropriate supervision to children in care. The Director and staff denied the allegations. The Director and staff stated the children are visually supervised and the playground gates are secured. The interviews revealed that a child has not exited the playground gates unsupervised or an unknown adult has not accessed the playgrounds or the children.

Several children stated the playground gates were locked and several children stated they do not know if the gates were locked. The children did not disclose anything inappropriate with the supervision by staff. The parents stated they do not have any issues or concerns with the playgrounds or the staff.

Based on the interviews and information obtained, there was conflicting evidence to corroborate the allegations that the “Playground is not appropriately enclosed while children are in care”, and the “Staff do not provide appropriate supervision to children in care”, therefore the allegations are found to be UNSUBSTANTIATED meaning that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Facility Director, Amy Fagan. The Director was provided a copy of the report, Notice of Site Visit, and the appeal rights. LPA observed the notice of site visit being posted at the facility.
