Licensing Program Analyst (LPA), Selina Siao conducted an unannounced inspection to deliver the above complaint findings. The initial inspection was conducted by LPA Siao on 07/03/2019. LPA conducted a tour of the facility.
Throughout the course of investigation, interviews were conducted with several staff members and several daycare parents. Information gathered that on June 18, 2019, a toddler was left unattended at the playground during transition time. The child was brought back to the room by a staff member after a few minutes. Information gathered also indicated that a teacher aide was left alone supervising the children in the morning. Based on information obtained and LPA’s interviews which were conducted and record reviews the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED, California Code of Regulations, Title 22, 101229(a)(1) and 101216.2(e) are being cited on the attached LIC 9099D. Appeal Rights (1/16) were discussed and provided. Signature at the bottom of this report confirms receipt. Notice of Site Visit was posted during this visit and will remain posted for 30 days.

This requirement was not met as evidence by: On 06/18/2019, a child was left alone at the toddler playground during transition for a few minutes. The child was brought back to the classroom by the teacher. This poses a potential health and safety risk to clients in care.

An aide shall work only under the direct supervision of a teacher. This requirement was not met as evidence by: Teacher aide was left alone supervising children in the morning until a teacher arrives. This poses a potential health and safety risk to clients in care.

Throughout the course of investigation, interviews were conducted with several staff members and several daycare parents.
Although the allegations regarding staff holding a child down on the cot during nap time, staff is rough with the children when changing diapers, small rocks at the toddler playground is unsafe for the children in care, facility operates out of ratio and facility failed to provide an incident report to the parent afer a child sustained a bruise on the eye may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.
Appeal Rights (1/16) were discussed and provided. Signature at the bottom of this report confirms receipt. Notice of Site Visit was posted during this visit and will remain posted for 30 days.
