Staff handled day care children in a rough manner

Licensing Program Analyst, Selina Siao conducted an unannounced inspection to deliver the above complaint finding. The initial inspection and tour of the preschool classrooms was conducted by Analyst Siao on 07/09/2019 and with a follow up inspection on 08/20/2019. Throughout the course of investigation, records were reviewed and interviews were conducted with several staff members, several day care children and several daycare parents. On Nov 19, 2018, a staff member took a child's arm somewhat forcefully to get the child to clean up toys that the child had deliberately dumped on the floor. The child was crying as she was cleaning up the toys. The incident was observed by another person and a meeting was held with the staff on Nov 20, 2018 due to her behavior. A copy of the note from the meeting, along with the alleged staff member's signature acknowleding that she will use her voice in the future to ask the child to go to her and not hold the child's arm was obtained from the staff's file. Based on LPA’s observations and interviews which were conducted and record review the preponderance of evidence standard has been met, therefore the above allegations is found to be SUBSTANTIATED, California Code of Regulations, 101223 (a)(3) is being cited on the attached LIC 9099D.

Licensing Program Analyst, Selina Siao conducted an unannounced inspection to deliver the above complaint findings. The initial inspection and tour of the preschool classrooms was conducted by Analyst Siao on 07/09/2019 and with a follow up inspection on 08/20/2019. Throughout the course of investigation, records were reviewed and interviews were conducted with several staff members, several day care children and several daycare parents. On 07/01/2019, a staff member brought a mini bottle of wine between 4-6 oz inside her purse to school. The staff stated that she was planning to do decoupage during her break with the bottle. A few people interviewed said that the staff member appeared to be a little off that day but no one observed the staff member drinking or with alcohol on her breath. The staff retired as a result of the incident. Parents interviewed did not have any concerns regarding the above allegations. Based on information gathered, although the above allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.
