LPA A Locano completed un-announced complaint investigation visit to the facility today, to deliver final findings on allegations listed above, pertaining to Personnel Requirements, alleging uncleared adults in the facility. LPA met with Melinda Tretera, to delivered final findings on allegations as follows: Per complete review of all information which included visits to the facility, interviews with staff, children, contact with parents and review of classrooms and playgrounds, there was no evidence to prove or completely disprove that uncleared adults worked or had a presence in the facility in violation of Title 22 Regulation 101170 (b)(2)(A)(B)(C) regarding Criminal Record Clearances. Title 22 Regulation 101170 (b)(2)(A)(B)(C) allows volunteers at a facility without fingerprint clearances under the following conditions: (b)The following individuals are exempt from the requirement to submit fingerprints:(2) A volunteer that provides time-limited specialized services if all of the following apply: (A) - The volunteer is directly supervised by the licensee or a facility employee with a criminal record clearance or exemption. (B) - The volunteer spends no more than 16 hours per week at the facility. (C) - The volunteer is not left alone with children in care. Continued on next page...

Even though Director has confirmed that one of her adult children has volunteered at the facility in the past, meeting all the requirements for volunteers exempt from fingerprint requirements, however because no volunteer hourly roster was kept, there was no evidence to prove or completely disprove the allegations. As such, although the allegations may have happened, or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are UNSUBSTANTIATED, no violations issued to facility at this time. Final findings determined to be unsubstantiated. Director was provided a copy of appeal rights (LIC 9058 12/15) and signature on this form acknowledges receipt of these rights. It is noted, that Director has had her adult son who previously volunteered fingerprint cleared, to avoid any type of misconceptions in the future and will complete an employee file for her son, meeting all employee requirements, LPA Locano has verified fingerprints have been approved and cleared for adult son who had volunteered in the past. LPA provided copy of LIC 9213, “Notice of Site Visit,” and observed posting of notice during visit.
