On 01/18/2023 at 1:31pm, Licensing Program Analyst (LPA) Selina Siao, conducted an unannounced, case management inspection for the Action Level Exceedance (ALE) of lead detected in the facility water fixture. Upon arrival, LPA met with Director Rashelle Cultrera and Assistant Director Emily Wolford. The purpose of the inspection was explained, and facility was toured. There were 30 children in care at time of inspection with appropriate ratio.

LPA discussed the new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every five years after the date of the first testing.

LPA obtained copies of the External Water Sampler Self-Certification Form (LIC9275), Child Care Center Sampling Checklist (LIC9276) and Facility Sketch (LIC999) today. On 11/22/2022 the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW) of an ALE at the facility. The SWRCB report indicated the facility was inspected and samples were collected on 10/10/2022. The outlet/fixture reported with 5.5 ppb or greater lead exceedance level is as follows:

A – Kitchen sink faucet that is use for cooking food and drinking. Stopped using for cooking until the water tester return for testing.
F - Drinking Fountain located in the Pre K classroom. Drinking fountains on site has been turned off since COVID and facility has removed the drinking fountain since the high lead test result.
G- Drinking Fountain located at the outdoor preschool playground. Drinking fountain on site has been turned off since COVID and the fountain has been covered.

Director stated that the water outlet A, the kitchen sink faucet has not been use for cooking or drinking since they obtained the lead water testing result. Facility has been using the other water outlet for cooking which was observed by LPA Siao during today's inspection. Facility has replaced the kitchen faucet and the pipeline, facility has been waiting for the water tester to return for testing.

The drinking fountain F located in the Pre-K classroom has been removed since the facility obtained the test result.

The drinking fountain G located at the outdoor preschool playground has been shut off since COVID-19. During today's inspection, LPA observed the drinking fountain G to be covered by a zip lock back with zip tie, to ensure the fountain is inaccessible to the children in care. LPA advised Director to submit another LIC9276 upon completion of the retest of the kitchen faucet and playground drinking fountain G.

Grant funding will be available for testing and remediation of lead to the Child Care Centers that qualify. To make a determination of eligibility, refer to PIN 21-04-CCP. Director posted the lead water testing report at the facility during today's inspection.
