On 07/11/2023 at 2:10PM, Licensing Program Analyst (LPA) Selina Siao conduct an annual inspection. Upon arrival, LPA met with Director Rashelle Cultrera and proceeded to tour the facility. There were 46 children in three different classrooms including Pre-K 1, Preschool 1 and Discovery class supervised by three staff members during nap time. Facility is within staffing ratio. All required notices, forms and licenses were posted. Furniture and age appropriate equipment is in good condition. Rooms have adequate heating, lighting, ventilation and drinking water available for the children. Storage cubbies are readily available, and room accommodates class size. Napping equipment consists of cots which are kept in classroom and each cot has its own sheet or covering. Bathrooms are maintained with operational toilets and faucets with appropriate temperature. Paper towels and toilet paper are available. Bathroom is lighted and has ventilation. Food service area consists of a kitchen which is clean and free of hazards. Menu is posted. Adequate food is available for meals and snacks. Cleaning supplies are kept out of reach of children. Outdoor play area is a fenced playground with turf as cushioning. Climbing structures and slides are securely fixed to the ground. Sufficient shades are available for the preschool and pre-k playground. Equipment appears to be age appropriate and separated by age groups, infant and preschool. Drinking water is available for the children inside and outside as children has their own water bottle. The playgrounds are free of debris or potential hazards. Facility uses an electronic sign in and out system. First aid supplies and reviewed medication policy and storage, all areas are within compliance. Isolation area is the Director's office. Personnel and client records were reviewed. Staff members have the required measles and pertussis immunization and has a valid online mandated reporter training certificates. Reporting requirements was also reviewed. All personnel have the required criminal record and child abuse index clearances or exemptions. LPA reviewed Emergency Disaster Plan and last fire drill was conducted on 04/18/2023. Facility has an operating carbon monoxide detector located at the lobby. Facility has at least one staff member that has a valid EMSA approved CPR/FA when children are in care.

Based on observation and interview with the Director, the licensee did not comply with the section cited above as the facility had recently replaced the play structure at their preschool and pre-k playground. The construction started in May and it was completed at the end of June of 2023. Facility did not notify licensing prior to the alterations. This poses/posed a potential health, safety or personal rights risk to persons in care.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Child Care Providers can now sign up for Quarterly Updates and PINS through the DSS website at https://cdss.ca.gov/inforesources/community-care-licensing/subscribe. LPA discussed California Megan's Law with provider and advised her to go on the website at www.meganslaw.ca.gov.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP).

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

LPA discussed the safe sleep regulations with Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

All unusual incident reports shall be submitted to Licensing office via email at SDIncidentReports@dss.ca.gov or via fax at (619)767-2203.
