On 5/11/22 at 2:00 PM Licensing Program Analyst (LPA) Adrian Mangina conducted an unannounced Annual inspection with the Licensee. Upon arrival, LPA met with Licensee, Maria Louisa Ramirez Phillips. The one-story three bedroom two bathroom single story home was toured and inspected to ensure an environment safe for the care and supervision of children. Also present in the home were Licensee’s husband Roy Phillips, Assistant Maria Lourdes Valenzuela, Licensee’s son Bill Phillips and 10 day care children. Proper supervision and ratios were observed. The 3A40BC fire extinguisher, carbon monoxide detector, and smoke detector meet requirements and are operational. Licensee’s First Aid and CPR certifications expire on 5/2023. Helper’s First Aid and CPR are expired but Licensee states Assistant is not left alone with children.

At 2:01 LPA observed that garage and bedrooms not made inaccessible to children. 2:15 PM child #1 found sleeping on treadmill, not given adequate napping space 2:30 PM LPA observed medications in accessible drawer to left of stove in Kitchen. There were 2 children in adjacent dining room. 3:00 PM LPA observed that Licensee and assistant have not taken mandated reporter training. 3:15 PM LPA observed that last disaster drill was 5/21/21. At 4:00 PM LPA observed that Licensee and assistant files are not complete. at 4:30 PM LPA observed that Child #1, Child #2, Child #3, Child #4, Child #5, Child #6, Child #7, Child #8, Child #9 and child #10 do not have complete child files. at 4:31 LPA observed that immunization record is not being updated yearly. At 4:35 PM LPA observed that child roster is not current. At 5:00 PM LPA observed that the back yard has piles of patio stone tools, and old furniture on the right side of the backyard and on the left side there is a chicken wire fence that is falling down and a wooden fence that is rickety and has numerous boards that have fallen off and are loose, as well as two five foot rusty poles, one of which has a rusty and jagged hole approximately four inches by two inches, tools, hoses, lawn equipment, and various household items accessible to children in care.

There are no bodies of water on the property. Licensee states that there are no weapons in the home. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Licensee has provided adequate space for the children to eat, sleep and play within the home. Areas used for child care include: kitchen, dining room, living room, playroom, hallway and bathroom #1. Off limits areas include: bedroom #1, bedroom #2, master bedroom, master bathroom and garage that have not been made inaccessible to children There is a working phone at the facility. The licensee has sufficient age appropriate, safe, toys and equipment available. The home has a partially fenced backyard available for outdoor activities. Visual supervision at all times when children are outside.

Provider is hereby reminded of the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, ensure that all adults living or working in the home have criminal background clearances associated to the facility, corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers are not allowed in day care. All equipment that is used should be used only as intended by the manufacturer. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
