Due to Covid-19, Licensing Program Analyst (LPA) Mariah McCarty conducted a Tele-visit with the Facility Director to deliver findings for the above listed allegation.

The complaint alleged between January 13 - 26, 2021 an unqualified facility staff member provided supervision to Child Care Center children. It was alleged an unqualified staff member was given directives to relieve teachers for their breaks while the children were awake. Also, it was alleged the unqualified staff was left alone with the children over a period of two weeks.

The investigation consisted of interviews with staff members, as well as review of supportive documentation. The children could not be interviewed due to their young ages. The confidential interviews conducted revealed that a teacher aide was left alone with the children for at least two weeks while the children were awake, because there was not enough qualified staff to assist with relieving the teachers for their breaks.

The teacher aide supervised the children without a teacher present. It was disclosed that the teacher aide was left alone with the children on several occasions for hours at a time, which did not occur at a specific time of the day. Evidence gathered during this investigation supports the allegation that, unqualified staff provided supervision without a teacher present to children in care.

Based on the staff members’ qualifications or lack thereof, the schedule, timecards and the roster reviewed for the period of January 13-26, 2021 the facility did not have enough qualified staff available to cover breaks. When the teacher aide supervised the children, she was not under the direct supervision of a teacher. There was one teacher in each of the four classrooms, and there was one teacher aide present January 13-26, 2021. There was one infant classroom with a ratio of 4:1. There were two preschool classrooms with a ratio of 12:1 in each classroom; and there was one school-age classroom with a ratio of 12:1. The preponderance of evidence standard has been met therefore; the above qualifications allegation was found to be SUBSTANTIATED. This poses an immediate Health, Safety or Personal Rights risk to children in care. See the next page for deficiency cited.

An exit interview was conducted, appeal rights, and a copy of this report were emailed to Lori Haskell, Director.

(1)An aide who is 18 years of age or older, and who meets the requirements of this section and Section 101216, may escort and/or assist children in going to the bathroom, and may supervise napping children as specified in Section 101230(c)(1), without being under the direct supervision of a teacher.

Lori Haskell, Director will retrain all staff, substitute director and owner on teacher aide qualifications and duties regulation section 101216 and 101230, and she will submit a written statement and proof of attendance with staff and owner’s signature to LPA on or before 4/7/2021 via email at mariah.mccarty.dss.ca.gov. She will also hire qualified staff to assure aide is always under direct supervision of a teacher.

Based on records review of timecards, schedules, sign in and sign out sheets and interviews it was proven that a teacher aide provided supervision of children on several occasions over a period of two weeks during January 13-26, 2021, when the children were awake, without being under the direct supervision of a teacher. There was not enough qualified staff clocked in during January 13-26, 2021, to cover breaks and lunches for the number of classrooms open and the children present, and the substitute director did not always cover the breaks and lunches.
