On 09/05/24, Licensing Program Analyst (LPA) Kelli Waters arrived unannounced to the facility for the purpose of conducting an investigation due to a complaint received on 08/30/24. LPA met with Interim Director, Lianne Holgate, and acting Director Alinah Lopez, conducted a facility and vehicle inspection, took census, interviewed staff, and reviewed records.

There is an allegation that on 08/28/24, staff did not provide adequate care and supervision to a daycare child (C1), specifically that C1 was left unattended in the facility transportation vehicle and locked parking area for approximately 45 minutes.

During interviews it was revealed that C1, along with 8 other children, were picked up from Rock Springs Elementary School and Lincoln Elementary School on 08/28/24 at approximately 2:30pm. The 15-person, transportation van arrived at the facility at approximately 3:15pm, according to facility records. The driver (S1) took the children that exited the van into the facility, parked the vehicle and went to the kitchen area to continue working on other duties. At approximately 4:05pm, S2 entered the parking lot after finishing work and heard C1 crying and yelling “teacher”. S2 saw C1 in the locked parking area and notified staff to unlock the facility parking area gate. S2 stated that C1 told S2 that they had fallen asleep in the van. At approximately 4:15 pm, C1 was taken into the facility and given water and snack. Facility did not notify parent until C1 was picked up by at 4:45pm.

Based on confidential interviews and record review, it was determined that on 08/28/24, the after-school staff did not have adequate supervision of the children in care and did not realize C1 had not entered the facility with the other children and had been left in the transportation vehicle. Therefore the preponderance of evidence has been met and the allegation that staff did not provide adequate care and supervision is SUBSTANTIATED. California Code of Regulations, Title 22, Section 101229 (a)(1), is being cited on the attached LIC 9099D and is receiving an immediate civil penalty of $500. See LIC 9099D and LIC 421IM for details.

Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility for the next 12 months.
An exit interview was conducted with the Interim Director, Lianne Holgate and Acting Director, Alinah Lopez.

The Notice of Site Visit and Type A Deficiencies were given and must be posted for 30 days and a copy of this report must be made available to the public, at the facility site, for 3 years.

The acting Director will review Title 22 section with staff and retrain on the Responsibility for Providing Care and Supervision. The acting Director will provide a written statement of understanding/compliance to the LPA along with signatures of all staff via email.

Based on interviews, the licensee did not ensure care and supervision of children in care since after-school staff did not realize a child had been left unattended in the facility transportation van for approximately 45 minutes, which posed an immediate risk to the health and safety of children in care.

In addition, acting Director will submit a plan of checking in after-school children to ensure this does not happen again and will submit to LPA via email.

Director will provide LIC 9224 to all parents enrolled for a period of one year and keep a copy in the child's file for review by the Department.
