On June 14, 2022, at 8:10 a.m., Licensing Program Analyst (LPA), Nasha King met with NCCS West Child Development Center (CCC) Site Supervisor Sandra Romero to deliver the findings for the above stated allegations. During the investigation, LPA Hamilton conducted interviews with four children and four staff.  LPA Hamilton conducted a health and safety inspection of the CCC on March 17, 2022 and no safety concerns were noted. LPA obtained and reviewed the facility’s class roster, Incident Reports, and other pertinent documentation. LPA Hamilton was unable to interview the children identified as witnesses and/or “victims” due to the children’s parents did not return LPA’s telephone calls requesting interviews.

On March 10, 2022, Community Care Licensing (CCL) received information stating staff handled day care child in a rough manner, day care child sustained injury while in care, staff did not prevent inappropriate behaviors between day care children, facility is out of ratio and staff yell at day care children.

Regarding the allegations staff handled day care child in a rough manner, it was alleged that a staff grabbed a child by their arm, lifted child from the carpet and then let go once staff realized staff was being watched. Confidential interviews resulted in LPA being provided conflicting information. Confidential interview revealed to LPA that a parent witnessed a staff come over to a child lying on the carpet, grabbed the child’s arm and lifted the child up from the carpet by the child’s arm; whereas another confidential interview disclosed that the child was redirected and assisted by the teacher with an open hand to another area of the classroom. In addition, interviews with children disclosed that none of the children have been handled roughly or witnessed another child being handled roughly.

In regard to the allegation that a day care child sustained injury while in care, it was alleged that around two weeks prior to March 10, 2022, a child allegedly sustained a 3-4 inch bruise from being grabbed by staff and lifted from the carpet. Confidential interviews disclosed that the child had bruising from the alleged incident. Confidential interviews disclosed the CCC was made aware of the alleged incident and bruise the next morning by the child’s parent. Additional confidential interviews disclosed that the child’s arm was examined by a at least two staff the day following the alleged incident and no bruising was observed on the child’s arm. Confidential interviews disclosed that there was no picture(s) of the alleged bruise on child’s arm.

In regard to the allegation that staff did not prevent day care child from engaging in inappropriate behaviors, it is alleged that on March 8, 2022, a child had displayed inappropriate behaviors toward another child by touching the other child’s bottom over the child’s clothes. It was also alleged that staff did not witness the incident, but the facility has cameras that were not allowed to be reviewed by parent. Confidential interviews revealed that the facility attempted to review the cameras, but it was discovered that the cameras were offline and only recorded the last 30 minutes of the day. This incident occurred approximately about 4:30 pm and the cameras recorded some time after 4:30 pm. Confidential interviews and records review disclosed the CCC was operating within ratio at the time of the alleged incident. LPA was unable to interview the children identified as being involved in the incident

Regarding the allegation that facility is out of ratio, it is alleged that on March 3, 2022, S1 admitted to being short staffed and was alone in a classroom with 20 children. Confidential interviews resulted in conflicting information being provided to LPA. Confidential interviews disclosed that the CCC has had staffing issues but

has not had to operate out of ratio; whereas another confidential witness stated at lunchtime there was one staff at the front desk and the Director was with maybe 17 or 18 children. Confidential witness also advised LPA that the witness did not count the children present at the time. Confidential interviews also disclosed that the CCC uses Child Care Careers substitute agency when needed to avoid operation out of ratio. LPA Hamilton conducted unannounced visits to the CCC on March 17, 2022 and June 2, 2022 and the CCC was operating within Title 22 regulations.

Regarding the allegation staff yell at day care children, it was alleged that staff is always yelling. Confidential interviews again resulted in conflicting information being provided to LPA. Confidential interviews disclosed that none of the children or parents have advised the CCC of any child being yelled at; whereas other confidential interviews stated one staff can be heard from the entrance of the facility. Confidential interviews disclosed that there is a staff that has a naturally loud, raspy tone but is not intentionally yelling at anyone.

Based on confidential interviews, observations and record reviews, the allegations that staff handled day care child in a rough manner, day care child sustained injury while in care, staff did not prevent inappropriate behaviors between day care children, facility is out of ratio and staff yell at day care children, may have occurred, however are not supported or proven by evidence. Therefore, the allegations are unsubstantiated.

A copy of this report, appeal rights and Notice of Site Visit were provided to the Director.

The Notice of Site Visit was posted by the Director prior to LPA leaving the facility and the Director was reminded this notice must be posted for 30 days.
