13 | On October 16, 2023, at 10:16 AM, Licensing Program Analysts (LPA's) Courtnee Peebles and Tricia Danielson arrived unannounced to NCCS WEST MISSION CDC (CCC) and met with director, Sandra Romero to discuss the investigative finding of the allegation listed above. On October 16, 2023 at 10:16 AM, LPA conducted a tour and census of the CCC. During the investigation, LPA conducted confidential interviews with five staff (D,S1,S2,S3,S4).
On August 7, 2023, a complaint was received with allegations stating, staff member inappropriately touched child while in care, and staff hit daycare child while in care. Confidential interviews revealed that S1 moved from the four’s classroom a month and a half prior to the allegations above. Interviews also revealed staff take children to the restroom in groups and supervise children from the door as children in this class are potty trained. C1, specifically, was independent with toileting needs and did not require any assistance even when accidents happened. Due to ratio concerns the CCC chooses not to combine classrooms preventing C1 from being in S1’s care. However, interviews also revealed that there are times at the very end of the day when the CCC may need to combine classes. LPA was unable to corroborate whether S1 provided supervision to C1.
Based on information obtained there is not enough evidence to prove that a staff member inappropriately touched child while in care and staff hit daycare child while in care. Therefore, the allegations are deemed unsubstantiated at this time. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.
A notice of site visit was provided and must remain posted for 30 days. A copy of this report and appeal rights were given and explained to Director Sandra Romero
