On 10/25/2022 at 11:05am, Licensing Program Analyst (LPA) Selina Siao conducted an unannounced inspection to deliver the above complaint finding. Upon arrival, LPA met with Site Director Sandrine Buntin to conduct a tour of facility to gather census of the children and staff members. Most of the children were at the preschool and toddler playground. Staff present have the required background clearances and are associated to the facility.
Throughout the course of the investigation, interviews were conducted with licensee, Site Director, several staff members and several day care parents. Based on interviews conducted and records reviewed, S1 and S2 were working at the facility without their prior to their background clearances being associated to the facility for more than five days. S1 no longer works at the facility and S2 is a current staff who has been working at the facility since March or April of 2022 but her fingerprint was not associated to the facility until the current Site Director noticed it on August 26, 2022. The preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED, California Code of Regulations, Title 22, 101216.1 is being cited on the attached LIC 9099D. Civil penalty is being assess today.

This requirement is not met as evidence by S1 and S2 was working at the faciltiy prior to their background clearance being associated to the facility. S1 is no longer an employee at the facility and S2 worked at the faciltiy for a couple months prior to being associated to the facility. Civil penalty of $1000 is being assessed today. This poses a potential health and safety risk to clients in care.

Upon arrival, LPA Siao met with Site Director Sandrine Buntin to conduct a tour of the classroom area to gather census. Facility is within ratio during today's tour and all staff members present have the required background clearances and are associated to the facility.
Throughout the course of the investigation, interviews were conducted with licensee, Site Director, several staff members and several day care parents. Based on interviews the information obtained from interviews they were contradictory to the above allegations. Therefore, the allegations are determined to be unsubstantiated which means although the allegations may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred. Appeal Rights were discussed and provided. Facility was advised to post the Notice of Site Visit and that failure to keep it posted will result in $100 civil penalty.
