25 | On 02/28/20 at 8:30 a.m., Licensing Program Analyst (LPA), Rajani Goudreau conducted an unannounced case management incident inspection to follow up on a self-reported incident that occurred on 02/04/20. Upon arrival, LPA met with Director, Paola Carbajal and proceeded to tour the facility. The following ratios were observed: 20 children in care with 10 staff present. Facility is within proper ratio/capacity limitations. Facility operates Monday through Friday from 7:00 a.m. to 5:30 p.m.
The incident was self-reported by the facility in a timely manner to Community Care Licensing on 02/05/20. Information gathered indicates, on 02/04/20, two company employees during a classroom observation observed staff # 1 (S1) restraining children in care as a form of redirection. LPA observed video footage dated of 02/04/20 of classroom #3. LPA was unable to see the entire classroom on video footage due to the angle of the camera. LPA observed in video footage seven children in care with two staff members. LPA observed staff in video, interacting and playing with children in a positive manner. LPA observed in video footage, staff #1 (S1) redirecting child #1 (C1) by holding child's hands and guiding child to an activity. LPA did not observe C1 to be in distress. During review of video footage, LPA determined typical redirection procedure for staff is to hold the children's hands and guide them to an activity. According to staff, an incident occurred on 02/04/20 during circle time where child #2 (C2) was playing behind S1 while attempting to climb on the couch. S1 indicated she placed her hand over a space near the couch to prevent child from climbing on the couch. In addition, another situation occurred during circle time where S1 was holding the hand of child #3 (C3) and child started to pull away and S1 continued to hold onto C3's hand. Based on staff and children interviews and video footage review, LPA was unable to determine S1 restrained a child or children in care resulting in a personal rights violation. S1 was placed on leave on 02/04/20 pending review of the incident. S1 returned to work on 02/10/20 with no violations found. LPA discussed with Director, strategies for positive redirection.
