On 03/06/24 at 11:30am, Licensing Program Analyst (LPA), Samantha Clenista conducted an unannounced case management site inspection to address facility’s change of capacity application. Upon arrival, LPA met with Center Director, Martha Kaeg. Lisa Grygera (Area Director) arrived soon after to join LPA’s inspection. All indoor and outdoor activity space utilized for the children were inspected today. The facility is requesting to decrease their overall capacity from 59 children to 40 children: 20 preschoolers (ages 3-5yo) in Classroom #1 and 20 toddlers (ages 18-36 months) in Classrooms #2 and #3. Fire clearance was granted on 01/30/24. The areas used for the toddler program indoors were observed to be separate from the preschool program. LPA informed Facility Representatives that the programs shall never commingle at any given time and that staff are required to maintain direct visual supervision of the children at all times during indoor and outdoor play. There were 19 children with 7 staff members.

LPA continued to tour the facility and measured all indoor and outdoor activity space. The total indoor activity space measured at approximately 2,263.07 sq. ft., sufficient for requested capacity. There is a total of 2 toilets and 2 sinks available for the preschool children, and 4 sinks and 3 toilets available for the toddler children. All rooms currently have a changing table within arm’s reach of a sink. Facility Representatives were reminded that all infant bottles (if any) shall have their name and date on them daily. Infant needs and services plan will be stored in the classroom in a binder per child and Facility Representatives were reminded that they have to be updated quarterly. LPA observed all indoor play space to be complete with age-appropriate furniture and equipment, including tables, chairs, cubbies, napping cots/mats, bookshelves, and other activity supplies for the children. There are several stairs that lead from the main entrance to the classrooms. Facility Representatives stated that all children are escorted to and from the classrooms by their parent during pick up and drop off.

LPA observed baby gates at the bottom and top of the stairs that are within the classroom. There is a separate staff restroom located within the Charter school next door, equipped with 2 toilets and 2 sinks. Facility Representatives stated that the director's office and one toilet/sink labeled in the toddler Room #3 restroom will be the isolation area for children who are ill. There is an operational carbon monoxide detector on site located in the Director’s Office. All required documents were observed posted in the main parent drop off/pick up area.

The facility currently has three outdoor playgrounds (one for toddler, one for the preschool, and a garden area that the facility would like to utilize between both programs at separate times). LPA informed Facility Representatives that children must be escorted to and from the playground, and that staff must maintain direct supervision at all times to ensure the health and safety of all children. The fenced in toddler playground measured at approximately 819.52 sq. ft., sufficient for only 10 children at one time. Facility is requesting to be licensed for 20 toddlers. A playground waiver to share the toddler playground at different times in the AM and PM due to limited square footage shall be submitted and approved prior to licensure. The fenced in preschool playground measured at approximately 1,968.83 sq. ft., sufficient for requested preschool capacity. The entire playground area was observed to be fully fenced in with fencing that was measured over 4ft. high. Area had sails used for shade. Area had age-appropriate toys and play equipment and had rubber turf and rubber matting under play structure, sufficient to sustain a fall. Drinking water is readily accessible inside and outside the classroom via refillable purified water outlets and the facility provides the children with water cups daily. Facility Representatives were reminded that any changes to the facility must be reported to and approved by Community Care Licensing. Facility Representatives stated there are no firearms or weapons on site. Facility Representatives were advised to conduct ongoing checks of the entire facility to ensure all hazardous items (especially if a label states, “Keep out of reach of children”) are inaccessible to children by either placing it up on high surfaces, locked cabinet/drawer, or removed completely.

LPA reviewed with Facility Representatives the LIC 311A, Records to Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

LPA discussed the safe sleep regulations with Facility Representatives and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep, as an additional resource. LPA also informed Facility Representatives of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Facility Representatives were reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. Prior to licensure, the following is needed:
  • Submit a waiver request to share the toddler playground at separate times due to limited space.

Exit interview was conducted and report was reviewed with Facility Representatives. A license for 20 preschoolers (ages 3-5yo) in Classroom #1 and 20 toddlers (ages 18-36 months) in Classrooms #2 and #3 may be granted upon receiving the above corrections and after conducting a final file review. Facility Representatives stated their understanding and that this report shall be kept available at the facility for public review for 3 years.

Due to computer malfunction, LPA will email a copy of this report along with the Notice of Site Visit and appeal rights to Director by 5pm today. Director is advised that her response to the email within 24 hours of receiving it will act as her signature. Director is aware that the Notice of Site Visit must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
