Licensing Program Analyst (LPA) Vicky Williamson conducted an unannounced complaint inspection for the purpose of delivering complaint findings in regards to the above allegations. LPA met with Director, Celia Carrizosa. There were 12 infants with 3 staff members. It was alleged that facility staff failed to meet the needs of daycare children, staff not using appropriate napping methods. Interviews were conducted with previous Director Ellie Jackson, facility staff and several daycare parents. Children were unable to be interviewed due to being non-verbal. Information received indicated that children have been observed with snotty noses, dirty faces, child #1 was left in a diaper full of feces and staff allowing children to cry doing nap time without being comforted. A total of 7 staff members denied the allegations. Facility staff interviewed stated that the noses and faces of daycare children are continuously wiped and kept clean throughout the day. Staff stated that wipes and tissue are kept in every classroom and on the playground.

A few staff stated that after lunch dried food has been observed on the faces of children; however, state that the children’s hands and faces are cleaned after lunch and prior to laying down for nap. The same staff stated that diapers are changed every hour or as needed and prior to the child’s departure from the facility unless otherwise instructed by the daycare parents not to change the child’s diaper. A total of 6 facility staff denied the allegation and stated that children are never left in soiled diapers. Staff #1 stated that on one occasion staff #2 left a daycare child in a soiled diaper upon the return of her 10- minute break; however, was unable to provide LPA with a specific date. Staff #2 denied leaving a daycare child in a soiled diaper while staff #1 was on break. Staff #2 states that she always checks the diapers of daycare children when relieving any staff members for breaks throughout the day. Five staff interviewed stated that children are never left crying without acknowledgement from staff and the child being soothed and comforted. Staff #3 states that she has heard children crying during nap time, however states that she is unable to determine if the staff members are soothing the child or not, due to being in a different classroom.

Information received indicated that child #1 was left on a cot without a sheet. Staff interviewed denied the allegation and stated that sometimes the sheets tend to slip off of the cribs and cots but that they are immediately fitted by on the mattress of the crib or the cot. Daycare parents interviewed expressed no concerns regarding the allegations. Based on evidenced gathered from information received and interviews conducted there is no collaborating evidence to provide proof that the alleged allegations occurred. Due to conflicting statements obtained during the course of the investigation, the above allegations are found to be unsubstantiated meaning that although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

No deficiencies cited during today’s inspection. Director was provided the appeal rights (LIC9058 01/16) and their signature on this form acknowledges receipt of these rights. Provided Notice of Site Visit. LPA observed Director post Notice of Site Visit.
