At 9:10AM on September 26, 2022, Licensing Program Analyst (LPA) Alaina Wilburn conducted an unannounced complaint visit. LPA met with Assistant Director Wilma Cabrera, to deliver findings on the above stated allegation.
Investigation consisted of; interviews with Staff, Children and potential witness.
On 08/11/2022, a complaint allegation was received by the Community Care Licensing (CCL) office that Staff did not observe day care child in soiled clothing. During interviews, LPA Wilburn observed two separate incidents of questionable supervision involving Child #1 (C1). In the first incident, C1s parent arrived for pick up and observed C1 in a different outfit. It was determined that C1 had an accident and soiled themselves. C1 went to the cubbie, grabbed a bag, went to the restroom, changed out of the soiled clothing and returned the bag with the soiled clothing to the cubbie without the staffs awareness or knowledge of the incident. In the second incident, C1 was playing outside with friends. It’s alleged that C2 shoved rubber wood chips from the playground in C1’s underwear. C2 denies incident and staff interviewed denied observing such incident; however, later that evening at home, while C1's parent was preparing child to be bathed, parent observed

wood chips, dirt and grass in C1's underwear. Pictures were obtained of the wood chips and C1's underwear, but based on interviews, it cannot be proven that another child was involved in putting the wood chips/dirt in C1’s underwear. However, according to confidential interviews conducted, there has been a concern in regard to active supervision on the playground; more specifically, at the end of the day when the 3 preschool classrooms are combined together outdoors before pick up.

Based on interviews conducted and LPAs observation, the preponderance of evidence standard has been met and the allegation that Staff did not observe day-care child in soiled clothing is found to be SUBSTANTIATED. The facility is being cited in accordance with Title 22 Child Care Center Regulations, Division 12, Chapter 1, Section 101229(a)(1): Responsibility for Providing Care and Supervision. This posed a potential risk to the health, safety, or personal rights to the children in care. See LIC9099D for cited deficiency.

Exit interview conducted. A copy of this report and appeal rights were discussed and provided to the Assistant Director Wilma Cabrera on this date.

A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS.

Investigation consisted of; interviews with Staff, Children and potential witness.
On 08/11/2022, a complaint allegation was received by the Community Care Licensing (CCL) office that day care child being harassed by other day care children. During interviews, staff deny observing C1 being harassed by any of the day care children. Staff acknowledge that children use the restroom and are not given privacy, which is acceptable according to Title 22 Regulations. When C1 was interviewed, there were inconsistencies in information provided.
Based on interviews with staff and observation conducted, the allegation that day-care child being harassed by other day-care children, may have happened or is valid, but there is not a preponderance of evidence to prove the alleged violation did or did not occur. Therefore, the allegation is UNSUBSTANTIATED at this time. Exit interview conducted and a copy of the report along with the appeal rights were provided to Assistant Director Wilma Cabrera.

Director will submit a written plan of action detailing how Staff will actively supervise children indoors and outdoors. Director will include a staff schedule for the day time and afternoon, as well as documentation from the upcoming In-Service training. The plan is due to LPA by plan of correction date of October 7, 2022.

Based on interviews conducted and LPAs observation, staff failed to properly supervise C1 on two separate occasions, where C1 changed out of soiled clothing without staff's knowledge, and C1 had rubber wood chips in underwear from the playground, which poses a potential health, safety or personal rights risk to children in care.
