On 03/22/2024 at 10:10 a.m. Licensing Program Analyst (LPA), Cindy Meier conducted an unannounced complaint inspection to deliver the findings for the above allegation. LPA met with Site Supervisor, Claudette Jordan, and advised Site Supervisor of the purpose of the inspection and conducted a tour of the facility. There were sixty-two (62) children, and sixteen (16) staff present during the inspection.

During the course of the investigation, interviews were conducted with the Site Supervisor, facility staff, day-care parents and day-care children. The facility roster, personnel records, photographs, the facility emergency disaster plan and facility sketch, and City of San Diego Deputy Fire Marshal notes were obtained and reviewed by LPA.

It was alleged that the facility classroom entrance is crowded and the facility is cluttered overall, limiting walkways and exit routes and children’s napping equipment is arranged in a manner unsafe for day-care children in care.

During LPA’s inspections conducted on 02/22/24 & 03/22/24, LPA observed the indoor passageways to be free of obstruction and children’s cots/mats to be arranged safely.
Site Supervisor denied the allegation, stating she ensures there are no obstructions in the hallway for entering and exiting. Staff interviewed stated they do not have concerns about the safety of children and mentioned that safety practices are reviewed each month during staff meetings. LPA reviewed documentation of monthly fire drills and notes from a recent visit by the fire marshal, which states all exits and entrances were in compliance. Parents expressed a high level of satisfaction with the care the facility provides and did not express concerns for safety. Children interviewed mentioned safety rules and practicing fire drills.

Due to conflicting information obtained throughout the course of the investigation and no corroborating witnesses, LPA was unable to determine whether or not the allegation occurred. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview was conducted and the report was reviewed with Site Supervisor, Claudette Jordan. A copy of this report, along with Appeal Rights (LIC9058 03/22), was provided. A Notice of Site Visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
