On November 30, 2023 at 8:20 a.m. Licensing Program Analyst (LPA) Leilani Curtis conducted an unannounced Case Management inspection, for reported Lead Exceedance. Upon arrival LPA met with staff member Deborah Kentner. Also present in the facility were 9 daycare children and one other staff member. Facility was within ratio & capacity. Director Tammy Walker arrived at the facility at approximately 8:39 a.m. Staff members have the required background clearances and are associated to the facility. LPA interviewed the licensee and examined the faucets and drinking fountains deemed an Action Level Exceedance. Facility provided facility sketch and required forms (LIC 9275/9276) to Department on August 30, 2023 via email.

Faucets and drinking fountains reported with 5.5 ppb or greater lead exceedance levels were as follows:

Kitchen Sink Faucet-Sample Site A 6.2 ppb

The director states that the kitchen faucet in exceedance has not been repaired or replaced because it is not used by the staff or children for food preparation or drinking, at any time. The facility provides bottled water for the children and maintains approximately 8, 1-gallon bottles of water on site at all times to refill the children’s water bottles. The director states that she refills the 1-gallon water bottles as necessary, and she has enough staff on site to remain in ratio when she has to leave the facility to obtain additional water. The director states that the drinking fountain located between the T.V. room and the lunchroom was not tested. The director states that she thought the drinking fountain was not working. LPA and Director turned on the drinking fountain and observed that it is fully functioning. LPA advised Director that the drinking fountain should have been, and will need to be tested. The director also states that the water fountain is not used, and they plan on removing the drinking fountain. During the inspection Director Walker turned off the water to the drinking fountain and placed a sealed bag over the fountain.

The director states that children bring lunch from home. The facility provides snacks. Any fruit consumed is washed using bottled water. All staff have been informed not to use the kitchen faucet for drinking water or food preparation. LPA observed that the kitchen is inaccessible to children. The director understands that if she plans or expects to begin using the kitchen faucet for food preparation or drinking water the lead level in the water must be remediated and Community Care Licensing Regional Office must be notified prior to its use.

See LIC809D for cited deficiencies. A civil penalty has been assessed.

Exit interview conducted and report was reviewed with Director Tammy Walker. A notice of site visit was given and must remain posted for 30 days.

The director made the drinking fountain inaccessible at the time of inspection. The director states that she will have the drinking fountain removed and she will send LPA a photograph of the sink with the drinking fountain removed via email by 12/08/23.

Based on observation and director statement, the licensee did not comply with the section cited above. The drinking fountain located between the T.V. room and lunchroom has not been tested for lead. This poses a potential health, safety or personal rights risk to persons in care.
