13 | On 9/27/22 at 11:30am, LPA Adrian Castellon conducted a 10 day complaint inspection and to deliver complaint findings for the above allegation. LPA met with Director Ana King and discussed the purpose of the inspection. There were forty seven day-care children present. It was alleged that staff do not ensure facility food is not a choking hazard to day care children. During the course of the investigation, two unannounced inspections were conducted. Interviews were conducted with facility staff. Documents were obtained pertaining to the allegation.
Based on the licensee's admission and interviews conducted and CDC website regarding foods that are choking hazards for children of this age, the allegation is substantiated. Staff does not ensure facility food is not a choking hazard to day care children. Children were fed uncooked raisins, marshmallows, and hard pretzels in June 2023 as part of a food art activity. As such, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. Violations of the California Code of Regulations, Tittle 22, are being cited on the attached LIC9099D. Final findings delivered as substantiated, a type ‘B’ violations are being issued, as the situation may pose a risk to children in care.
