32 | During LPA’s interview with S1, S1 acknowledged that she used the children’s restroom, as no other staff were available to relieve her for a break. Teacher (S2) acknowledged in interview with LPA, that S1 used the bathroom, leaving S2 alone with 14 children. According to staff, during the incident, a white board was placed in the bathroom threshold for privacy and S2 redirected children to the opposite side of the classroom as the bathroom stalls do not contain doors. While S2 was left alone with 14 children, teacher child ratio was out of compliance.
Based on S1 and S2’s admissions, children’s interviews, and record review, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1) are being cited on the attached LIC 9099-D.
LPA Daniela Huerta informed Director, Maria Cabello that this report dated 06/13/2024 document(s) one (1) Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Daniela Huerta informed the Director, Maria Cabello to provide a copy of this licensing report dated 06/13/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with Director Maria Cabello. Applicant/Licensee Rights (LIC 9058) along with a copy of this report was provided to Licensee. A notice of site visit was given and must remain posted for 30 days. |
