13 | LPA A Locano completed un-announced complaint investigation visit to the facility today 7/8/19, to deliver final findings on allegations listed above, pertaining to Personal Rights violation, alleging staff handled child in a physically inappropriate manner. LPA met with Director Summer Medina, to delivered final findings on allegations as follows: Per complete review of all information which included visits to the facility, interviews with staff, children, contact with parents, review of classroom operation and review of documents from facility, addressing the issue of proper handling of children with one staff member, It was confirmed that one staff member handled a child in a physically inappropriate manner. Even though the inappropriate handling may have not been done with the purpose of intentionally hurting a child, or as punishment, it has been confirmed that a child was handled inappropriately by one staff member, which posed a potential risk of harm to children in care, which violates a child’s personal rights. As such, the preponderance of evidence standard has been met, therefore the above allegation of Personal Rights, alleging staff handled child in a physically inappropriate manner, is found to be SUBSTANTIATED. Violations of the California Code of Regulations, Tittle22, are being cited on the attached LIC9099D. Final findings delivered as substantiated, a type ‘B’ violation is being issued, as the situation posed a potential risk of harm, to children in care. The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and signature on this form acknowledges receipt of these rights. LPA provided copy of LIC 9213, “Notice of Site Visit,” and observed licensee posting notice during visit. |
