13 | On 01/30/23 at 5:30PM, LPA Luigi Gargaro conducted an unannounced complaint finding delivery visit to the facility regarding the above allegation. During the course of the investigation, analyst conducted interviews with the facility director and staff, children in care and day care parents. LPA also toured the facility and reviewed their daily cleaning practices including the products and mixtures used for that.
From the evidence gathered, it could not be conclusively proved or disproved that a chemical smell, resulting from the facility's cleaning and sanitization process, was strong enough to cause discomfort or be harmful to those in the facility. While a cleaning scent can be detected in the facility and on occasion may affect some working or attending there by causing minor irritation, based on their sensitivities, there was insufficient evidence to either substantiate or refute the allegation that the scent creates an unsafe environment. Therefore the allegation was determined to be unsubstantiated.
An exit interview was conducted and the report was reviewed with the facility director Elizabeth Matranga. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
