On January 24, 2023 at 10:30 am, Licensing Program Analyst (LPA), Jessica Rubio met with All Saint’s Preschool (CCC), Director (AD), Carol Magaldi to discuss the investigative findings of the allegations listed above. On November 17, 2022 at 2:30 pm, LPA conducted a tour and census of the CCC. During the investigation, LPA Rubio conducted confidential interviews with AD, and three staff (S1, S2, S3). LPA also obtained documents pertinent to the investigation.

On November 15, 2022, a complaint was received alleging staff do not properly supervise daycare children; specifically, that S2 and S3 have left children unattended on the changing table and on the playground outside. The complaint additionally alleges that a daycare child sustained injury while in care; specifically, that a child, C1 was injured as a result of S3 sitting C1 on a shelf and C1 falling off.

Regarding the allegation that staff did not properly supervise daycare children, interviews with staff revealed at times of transition from outside to inside, children have been left unattended outside on the playground for 15 seconds to 2 minutes. Other interviews revealed no children have been left alone outside on the playground. One interview revealed children are left unattended on the changing tables while other interviews revealed children are not left unattended on changing tables and if teachers need to walk away to grab something, they call the other teacher to supervise the child.

Regarding the allegation that daycare child sustained injury while in care, one witness interview revealed there was an incident approximately a year ago, of C1 being sat on a shelf by S3 and falling off, sustaining redness to the back of C1’s head. S3 denied she has sat any child on a shelf nor has any child fallen off of a shelf and been injured. There were no other staff witnesses to the alleged incident. Record review did not reveal an incident regarding C1 falling off of a shelf and being injured.

Based on confidential interviews and conflicting statements, the allegation that staff did not properly supervise daycare children and daycare child sustained injury while in care may have occurred, however is not supported or proven by evidence. Therefore, the above allegations are unsubstantiated. An exit interview was conducted and a copy of this report and appeal rights were discussed and will emailed to Director Carol Magaldi. A notice of site visit was also provided and must remain posted for 30 days.
