On August 10, 2023, at 9:30 a.m., Licensing Program Analysts (LPA), Gloria Gonzalez conducted a complaint inspection to deliver findings and met with Licensee and Co-Licensee, Rosa and Fausto Rivas, regarding the above allegation. LPA advised Licensee of the purpose of the inspection and conducted a tour of the facility. There were five (5) daycare children and no staff members present during the inspection.

During the course of the investigation interviews were conducted by the Department and SDPD with Licensee and Co-Licensee, several daycare children, several daycare parents and several staff members who denied observing inappropriate activities. Parents or daycare children interviewed did not raise any concerns regarding inappropriate activity by facility staff. Licensee and Co-Licensee denied the above allegation. There was no corroborating evidence regarding the allegation. Due to conflicting information obtained from the interviews, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the above allegation is found to be unsubstantiated.

A copy of this report and appeal rights (LIC 9058) was provided to Rosa and Fausto Rivas. LPA observed Licensee post LIC9213 – Notice of Site Visit and Licensee was advised this notice is to be posted for 30 days from today’s date.

An exit interview was conducted with Licensee and Co-Licensee, Rosa and Fausto Rivas. This report was interpreted to licensee and Co-Licensee in Spanish by LPA Gonzalez.
