Licensing Program Analyst (LPA), Rajani Goudreau conducted a virtual complaint tele-visit inspection for the purpose of delivering findings to the above allegations. Upon visit, LPA met with licensee, Martha Mirada. Licensees' adult son assisted in translating visit. Also, present in the home licensees' helper. LPA toured the facility and verified facility was within proper Ratio/Capacity limitations. The investigation involved one facility inspection, observations, interviews and record review.

The Department received a complaint alleging licensee hit a daycare child, licensee transported children in an unsafe manner and licensee does not ensure that children are adequately fed. Licensee denies hitting daycare children, explaining that when daycare children misbehave, they are placed in Time-Out and she discusses their behavior with them. According to staff members, staff have not observed licensee hitting a daycare child. Staff disclosed when daycare children are misbehaving licensee talks to the children about what they did and/or places them in Time-Out. During interviews with daycare children, children denied observing licensee hit any children and indicated they are talked to when misbehaving. Parents interviewed did not disclose concerns regarding licensee’s discipline policy. See LIC9099-C continuation page...

Licensee denies transporting children in an unsafe manner, licensee indicated she transports daycare children in appropriate car seat restraints. During interview with staff members, staff have not observed licensee transporting children without adequate car seat restraint systems or in an unsafe manner. Daycare children disclosed to LPA to have a seat belt on or in a car seat while in the car with licensee. Parents interviewed did not disclose concerns regarding licensee transporting children in an unsafe manner. During interview with licensee and staff members, it was explained daycare children are fed snacks, breakfast, lunch and dinner. During facility inspection, LPA observed an adequate amount of food in the facility. Children disclosed they are fed when hungry. Parents did not report any concerns regarding the daycare’s food services. During the course of the investigation, LPA obtained inconsistent information and a lack of witness to corroborate the above listed allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

No deficiencies issued during today’s visit. An exit interview was conducted with licensee. LPA discussed and will provide the following forms to licensee via email: LIC9099, LIC9099-C, LIC9213 - A Notice of Site Visit and appeal rights. LPA informed licensee LIC9213 must be posted for 30 days from today’s date. COVID-19 State of emergency read receipt notification will be used in place of licensees’ signature.
