On October 13, 2021 at 11:50 AM, Licensing Program Analyst (LPA), Marie Hernandez conducted an unannounced complaint investigation inspection to deliver the complaint findings for the above allegations. LPA met with the Licensee, Guadalupe Murillo. Present are four children with the Licensee and the adult helper, Carlos Murillo.

Through the course of the complaint investigation, LPA conducted several confidential interviews with the Licensee, her husband, the adult helper, nine day care children, nine day-care parents, including former day care parents and the Reporting Party. The two infants could not be interviewed as they are non-verbal. During the initial complaint investigation on 08/18/2021, LPA conducted an inspection of the facility including the food supply and reviewed the children’s records. At time of inspection, LPA observed that there were plenty of perishable and non-perishable food items. LPA reviewed the children’s records and their emergency information. It is unclear whether the Licensee was provided the updated emergency information or not for child. The Department received a complaint alleging that the “Licensee's husband curses at children in care,” “Licensee did not update child's emergency information card,” and the “Licensee is not providing nutritious food to children.”

The Licensee, her husband and the adult helper denied the allegations and stated the Licensee’s husband did not curse at the children in care and that the children’s emergency information was updated. The Licensee and the adult helpers stated they provide nutritious meals and snacks for the children to eat. The interviews revealed that several children liked the food and several children did not like the food but that there was plenty to eat. Due to conflicting information obtained, it is unclear whether the Licensee’s husband cursed at the children or not. The day care parents stated they did not have any concerns or issues with the Licensee, adult helpers, or the facility.

Based on the interviews and information obtained, there was conflicting evidence to corroborate the allegations that the “Licensee's husband curses at children in care,” “Licensee did not update child's emergency information card,” and the “Licensee is not providing nutritious food to children”, therefore the allegations are found to be UNSUBSTANTIATED meaning that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Licensee, Guadalupe Murillo. The Licensee was provided a copy of the report, Notice of Site Visit, and the appeal rights. LPA observed the notice of site visit being posted at the facility. The Licensee stated it is understood that the notice must be posted for thirty days.
