Licensing Program Analyst (LPA) Rajani Goudreau arrived at the facility to conduct an unannounced Complaint inspection for the purpose of delivering the findings to the above allegations. Upon arrival, LPA met with licensee, Yolanda Lacarra. At time of inspection there were 11 children in care and two helpers. Facility is within Ratio/Capacity limitations. The investigation involved two facility inspections, observations, interviews and records review.

It was alleged licensee did not provide adequate food service, licensee did not address daycare child’s diapering needs in a timely manner, licensee used inappropriate form of punishment, and licensee left day care children unsupervised in a vehicle. Licensee denies providing inadequate food to children in care. According to staff and licensee, children are fed breakfast, am snack, lunch, pm snack and dinner. Licensee maintains a monthly meal menu reflecting food served daily to children in care. Licensee is currently participating in a food program. LPA reviewed the food program site visits for the months of 09/2019 and 10/2019 with no concerns noted. Parents interviewed did not express concerns regarding facility’s food services. According to interviews conducted with licensee and staff, children’s diapers are checked and changed if needed as soon as they arrive to the facility and prior to pick up. In addition, children’s diapers are checked and changed if needed throughout the day every 30 to 45 minutes. During interviews with parents, parents did not express concerns regarding facility’s diapering practices. Based on interviews with licensee and staff, children are not left unsupervised in the licensee’s vehicle. According to licensee, staff and children, current discipline policy at the facility is to redirect children and to sometimes place children on a thinking chair located in the main child care room. Parents interviewed were unaware of the licensee’s current discipline policy.

Although there were no witnesses or evidence to corroborate the allegations, the Department was unable to prove the allegations were false or could not have happened; therefore, the above allegations are unsubstantiated. LPA determined based on staff, licensee, parent and children interviews, there was inconsistent information obtained resulting in a lack of evidence to support the above allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

No deficiencies issued during today’s visit. An exit interview was conducted with licensee. LPA discussed and provided the following to licensee: LIC9099, LIC9099C and Notice of Site Visit-LIC9213. LPA informed licensee LIC9213 must be posted for thirty (30) days from today’s visit. LPA observed licensee post notice of site visit prior to exiting facility.
