On 5/23/22 at 9:00 AM Licensing Program Analyst (LPA) Adrian Mangina conducted an unannounced Annual inspection with the Licensee. Upon arrival, LPA met with Licensee, Rosa Fernandez. The two-story six bedroom four bathroom home was toured and inspected to ensure an environment safe for the care and supervision of children. Also present in the home was Licensee's husband and assistant Frank Fernandez . Assistant Karyna Fernandez arrived at the home at approximately 10:00 AM. There were 13 infants and toddlers in care. Upon arrival, LPA observed that Licensee was operating out of ratio. The 3A40BC fire extinguisher and smoke detector meet requirements and are operational. Licensee states there is no carbon monoxide detector in the home. There are no bodies of water on the property. Licensee states that there are no weapons in the home. Licensee does not have staff files, LPA unable to review staff files. A review of staff records on this date indicates that a resident in the home, adult #1 has not received criminal record and child abuse clearances or exemptions. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Licensee’s First Aid and CPR certifications expire on 11/6/23. Helper's First Aid and CPR certifications expire on 11/6/2023. Licensee has not provided proof of staff immunizations or Mandated Reporter Training. LPA reviewed 13 child files and found that 13 of 13 files are incomplete.

Licensee has provided adequate space for the children to eat, sleep and play within the home. Areas used for child care include: sunroom , family room and playroom. Off limits areas include: living room, kitchen, dining room, tv room, Bedroom 1, bedroom 2, bedroom 3 and entire second floor are inaccessible through use of

latches ,locks and gates. The fireplace in living room is screened and the staircase is barricaded. There is a working phone at the facility. The licensee has sufficient age appropriate, safe, toys and equipment available. The home has a fully fenced backyard available for outdoor activities.

9:05 AM LPA observed that there are 2 infants and 11 toddlers, Licensee states that there are also 2 school aged children enrolled

9:12 AM LPA observed granite cleaner in Family room closet
9:15 AM LPA observed that latch making living room inaccessible to children
9:25 AM LPA observed that food in refrigerator is uncovered
9:35 AM LPA observed that flooring has been installed outside in play area and is not complete and poses a tipping hazard to children.
9:40 AM LPA observed that Licensee is using a closet that was not approved in fire clearance as changing area

10:10 AM Licensee states does not have carbon monoxide detector
10:15 AP LPA obserfved Licensee's Mandated reporter training expired 1/15/21, assistant Frank Fernandez has not mandated reporter training, assistant Melissa Abones has no mandated reporter training certificate

bouncy seats, walkers, and jumpers are not allowed in day care. All equipment that is used should be used only as intended by the manufacturer. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov. LPA Mangina reviewed Covid-19 guidelines with Licensee and provided Covid-19 resources. LPA Mangina directed Licensee to website: https://www.cdss.ca.gov/inforesources/community-care-licensing to receive important updates and information.

Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Exit interview conducted and report was reviewed with the licensee, Rosa Fernandez. Notice of Site Visit (LIC9213) was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

LPA Adrian Mangina informed licensee Rosa Fernandez that this report dated 5/23/22 documents two Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Adrian Mangina informed the licensee to provide a copy of this licensing report dated 5/23/22 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
