Licensing Program Analyst (LPA) Jennifer Lott conducted an unannounced Plan of Correction visit regarding deficiencies that were cited on 03/24/2022. LPA was greeted at the front door by Licensee, Eduardo Nevarez and was granted entry after identifying herself and disclosing the purpose of her visit. Present in the home were both licensees and 4 children - one of which was in a pack and play crib.

During today’s visit, LPA toured the facility to ensure compliance. Additionally, during LPA's initial file review, it was noted that a fire clearance had not been issued. Fire Inspectors responded to the facility for their inspection on 03/21/22 and again on 03/29/22. During that inspection it was noted that the licensee did not make the required corrections and therefore, the fire clearance was denied. One of the required corrections included 2 door locks which needs a key to unlock from the inside of the home. If the door is locked and there is no key, you cannot open the door. LPA told the licensee that the door locks were required by the Fire Department to be changed and it would still be required by licensing.

LPA advised the licensee that due to their fire clearance denial, the licensed capacity would be reduced to 8, pending further review from the Department. Licensee began yelling at LPA and stated that they refused to sign the LIC 279 and that they refused to allow the Department to reduce their licensed capacity.

LPA also checked for compliance for corrections from citations issued on 03/24/22. LPA observed the lock on the kitchen cabinet not secured, an open bottle of peroxide on the dining room counter counter accessible to children, pool gate not secured and accessible. Licensee stated that training would not be completed until 04/23/22 when the required classes were available.

During the visit, licensee also contacted the local Fire Inspector and began to argue with them over changing the locks and the denial of the fire clearance application. Licensee became argumentative, yelling at the LPA. LPA told the licensee that the conversation needed to end and that they were going to leave. LPA attempted to leave the facility, but licensee had locked the keyed security door and refused to unlock it , continued to yell at the LPA. . LPA asked the licensee a 2nd time to unlock the door so they could leave, to which the licensee responded, "no". LPA asked a 3rd time to open the door and licensee, Eduardo refused again until Licensee Lourdes told Eduardo to let the LPA leave. It was at that time, licensee Eduardo, unlocked the door so LPA could leave.

Additionally, an extension will be granted for Preventative Health Training and Mandated Reporter Training through April 29, 2022 so that the licensee can complete. However, due to toxins being unsecured on the counter (peroxide) and the toxins under the kitchen sink not being locked, a civil penalty will be issued for repeat violation in the amount of $250.00 on the attached LIC 421FC. The civil penalty will continue at $100 per day until the violation is corrected.

Due to the unsafe environment, and licensee's refusal to sign, this report along with licensee rights and notice of sight visit were mailed via certified mail and emailed to the licensee with a read receipt. The notice of site visit was given and must remain posted for 30 days.
