32 | During the visit, licensee also contacted the local Fire Inspector and began to argue with them over changing the locks and the denial of the fire clearance application. Licensee became argumentative, yelling at the LPA. LPA told the licensee that the conversation needed to end and that they were going to leave. LPA attempted to leave the facility, but licensee had locked the keyed security door and refused to unlock it , continued to yell at the LPA. . LPA asked the licensee a 2nd time to unlock the door so they could leave, to which the licensee responded, "no". LPA asked a 3rd time to open the door and licensee, Eduardo refused again until Licensee Lourdes told Eduardo to let the LPA leave. It was at that time, licensee Eduardo, unlocked the door so LPA could leave.
Additionally, an extension will be granted for Preventative Health Training and Mandated Reporter Training through April 29, 2022 so that the licensee can complete. However, due to toxins being unsecured on the counter (peroxide) and the toxins under the kitchen sink not being locked, a civil penalty will be issued for repeat violation in the amount of $250.00 on the attached LIC 421FC. The civil penalty will continue at $100 per day until the violation is corrected.
Due to the unsafe environment, and licensee's refusal to sign, this report along with licensee rights and notice of sight visit were mailed via certified mail and emailed to the licensee with a read receipt. The notice of site visit was given and must remain posted for 30 days. |
