32 | The licensee speculated that one of the parents left the side gate open which allowed the children to elope from the facility. The licensee stated she was inside the facility preparing snacks and the assistant was supervising five children in the backyard when the incident occurred. The three (3) children involved in the incident were all unharmed.
Based on interviews which were conducted, and records reviewed, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 3), is being cited on the attached LIC 9099D. An immediate civil penalty of five hundred dollars ($500), is being assessed for the absence of supervision on the attached LIC-421IM.
LPA Sanchez informed licensee, Graciela Martinez that this report dated 05/05/2022 documents one (1) Type A citation which shall be posted for 30 consecutive days as there is/are an immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Sanchez informed licensee, Graciela Martinez to provide a copy of this licensing report dated, 05/05/2022 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with licensee, Graciela Martinez. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. |
