On 03/20/2023 at 8:45am, Licensing Program Analyst (LPA) David Miller conducted an unannounced Annual Required Inspection and met with the licensee Dulce Rodriguez. LPA disclosed the purpose of the inspection and was granted facility entry by the Licensee. The licensee, two staff and ten (10) children (one infant under 12-months and nine (9) preschool age children, were present in the facility during this inspection. This facility is a two (2) story, four (4) bedroom, three (3) bathroom house. Licensee accompanied LPA inside and out of the facility during this inspection. The following areas used for childcare are: the bottom floor bedrooms, bottom floor bathroom, the living room, the dining room and the fenced and shaded backyard. The off limits areas are the top floor and is made inaccessible to children using child safety gates. Bottom kitchen cabinets are made inaccessible to children using cabinet locks.

The fire extinguisher and smoke/carbon monoxide detector met requirements. Hazardous items were observed inaccessible to children during this inspection. The licensee has available toys, play equipment and materials. Children play outside in the fenced backyard. Licensee was reminded that continuous supervision is to be given to children whenever engaged in outdoor activities. All pools, spas, hot tubs, fishponds, or similar bodies of water are made inaccessible to children by covering or fencing as required by regulation. Licensee stated there are no weapons in the home.

Licensee’s First Aid and CPR certifications expire in August of 2023. Licensee has required immunizations. Licensee completed the mandated reporter training on 02/23/2022. The facility roster is maintained and was reviewed. The last fire and disaster drills were conducted and documented on 11/01/2022.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reminded Licensee of the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, and ensure that all adults residing or working in the home have criminal background clearances or exemptions. Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.

Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. No deficiencies cited.

A copy of the report and appeal rights (LIC 9058) was provided to the licensee and notice of site visit (LIC9213) was given to Licensee and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee Dulce Rodriguez.
